i AN ORDINANCE VACATING A PORTION OF SW GONZAGA STREET BETWEEN 68TH ANu 69TH
AVENUES AND DECLARING AN EFFECTIVE DATE. �
WHEREAS, the Tigard City Council initiated this vacation request pursuant to
Section 15.08.040 of the Tigard Municipal Code; and
WHEREAS, the reason and purpose for this vacation is to return the
right—of—way area to the adjacent property owners to facilitate development of
the parcels; and
WHEREAS, the vacation is recommended by the Planning Commission and the City
Engineer; and
WHEREAS, in accordance with ORS 271.100, and TMC Section 15.08.110, the
Council fixed a time and place for the public hearing and the Recorder
published notice and posted notice in the area to be vacated; and
WHEREAS, notice has been mailed to all property owners abutting said vacation
area and all owners in the affected area, as described in ORS 271.080; and
WHEREAS, the Council, having held a hearing on June 23, 1986, finds the public
interest will not be prejudiced by the vacation as provided by ORS 271,120 and
TMC Section 15.08.130; and
WHEREAS, the Council finds that it is in the public interest to approve the

WHEREAS, the Council finds that the following condition is necessary to vacate
said land

ordinance and it shall not be effective until a certified copy of
this ordinance has been recorded with the Washington County Clerk,
Assessor, and Surveyor.
THE CITY OF TIGARD ORDAINS AS FOLLOWS: s,
Section 1: The Tigard City Council hereby orders the vacation of that portion

as described on the attached Exhibit "A" and shown on the attached Exhibit
"B", and by this reference made parts hereof.
Section2: The Tigard City Council further orders that the vacation be
subject to the following condition:

CITY OF TIGARD
A parcel of land in the plat of WEST PORTLAND HEIGHTS, Washington County,
Oregon; the said parcel being all of S.W. Gonzaga Street (Seventh Street)
between S.W. 68th Avenue (Washington Street) and S.W. 69th Avenue (Grant
Street), in said plat described as follows:
Beginning at the Northwest corner of Block 32; thence, North 02° 33' 06"
East*, a distance of 60.00 feet, to the Southwest corner of Block 29;
thence, South 87° 28' 47" East, a distance of 199.97 feet to the Southeast
corner of Block 29; thence, South 020 33' 17" West, a distarnci of 60.00
-_ feet, to the Northeast corner of Block 32, thence, North 87' 28' 47" West,
a distance.of 199.97 feet to the point of beginning. The parcel of land to
be vacated being approximately 0.275 acres.
