Ordinance No. 85-27 3 CITY OF TIGARD, OREGON ORDINANCE NO, 8.55—.rte! AN ORDINANCE OF THE TIGARD CITY COUNCIL AMENDING CHAPTER 7.40, NUISANCES, OF THE TIGARD MUNICIPAL CODE, SETTING AN EFFECTIVE DATE AND DECLARING AN EMERGENCY. i B WHEREAS, Chapter 7.40, Nuisances, designates certain types of nuisances which affect the public health and safety which require abatement, and WHEREAS, the Tigard City Council finds that dangerous buildings threaten the 6 public health and safety, and WHEREAS, the present Chapter 7.40 does not designate dangerous buildings as nuisances, THE CITY OF TIGARD ORDAINS AS FOLLOWS: Section 1: There is hereby added to Title 7, Chapter 7.40 of the Tigard Municipal Code, Section 7.40.01.0(8) as set forth in the attached Exhibit "A" and is hereby adopted. Section 2 This ordinance is necessary to protect tha general welfare and safety of, the people of the City of Tigard because there is presently no -, authority to abate the threat posed by a number of dangerous buildings throughout the City which have been the subject of numerous complaints, and these buildings exhibit evidence of being hazards, therefore, an emergency is hereby declared to exist, and this ordinance shall become effective immediately upon passage by the City Council and approved by the Mayor. A dangerous building is one or more of the following: f k a. A structure that, for the want of proper F repairs or by reason of age and dilapidated condition, by reason uf poorly installed electrical wiring or equipment, defective chimney, defective gas connection, defective heating apparatus, f or for any other cause or reason, is especially liable to fire, r and that is so situated or occupied as to endanger any other building or property or human life. # t b. A structure containing combustible or explosive material, rubbish, rags, waste, oils, gasolina or flammable substance of any kind, especially liable to cause fire or danger to the safety of the building, premises, or to human life. C. A structure that is kept or maintained or is in a Filthy or unsanitary condition, especially liable to cause `; the spread of contagious or infectious disease or diseases. d.
