WAS ADOPTED BY CITY COUNCIL AND ADDED TO THF TIGMD CRDIINAL CODE, AND
DECLARING AN LMFItGENCY.
The City of Tigard ordains as follows:
Section 1. The following section in quotes is to be added to the Tigard
Criminal Code, as it was inadvertenly omitted when Ordinance No.
84-65 was adopted by City Council.
°7.28.050 Refusing to assist peace officer. (a) A person commits
the offense of "refusing to assist a peace officer" if upon
command by a person known by him to be a peace officer he
unreasonably refuses or fails to assist in effecting an authorized
arrest or preventing another from ccxrani.tting a crime.
(b) Refusing to assist a peace officer is a violation."
Section 2. .Section l above is servable. If any sentence, clause or phrase of
this Section is adjudged to be invalid by a court of competent
( jiuisd4 ion, that decision shall not affec-t the validity of the

remaining portion of this Section.

Section 3. This Section is necessary to protect the general welfare and
safety of the people of the City of Tigard because the above
Section was inadvertently ommited when Ordinance No. 84-65 was
adopted by City Council and added to the Tigard Criminal Code,
U-terefore an emergency is hereby declared to exist, and this
Section she become effective immediately upon passage and
approval by the City Council.
