AN OPWINANCE MAKINIG, IT UNLAWFUL TO TAMPER, WITH ANIMALS USED MR
LAW ENFORCEIMU PURPOSES AND DECLARING AN EMERGENCY.
MEREAS, the Tigard Police Department use dogs for police
services;
WHEREAS, the police have experienced situations in which
people tease the dogs while locked in a patrol car;
WHEREAS, dogs used for police work by other police
departments have been injured by deliberate acts;
WHEREAS, the police have experienced situations where the
dogs while acting in the line of duty have been called while
chasing a suspect and while tracking evidence; and
WHEREAS, the police depend on the dogs for law enforcement
purposes;
NOW TIMEFORE, THE CITY OF TIGARD ORDAINS AS FOLLOWS:
SECTION 1. The following shall be added to the Tigard
Municipal Code, Chapter 7:
a. A person camLits the crime of tampering with a dog used
for law enforcement purposes if
(1) the person intentionally tampers or interferes with a
dog_ while the dog is acting in the line of duty by calling
the dog, or by other behavior attempts to distract the dog
from doing or attempting to do what it has been instructed
to do by a police officer;
(2) The parson intentionally teases, ha-Tasses, or incites a
dog while the dog is caged, being transported, exhibited or
exercised, or while it is within a police vehicle; or
(3) The person intentionally tortures, strikes, injures or
kills a dog.
b. Tampering with a dog used for law enforcement purposes
is a Class A Mi.sdene-anor.
SECTION 2. This ordinance is necessary to protect the general welfare
W and safety of the people of the City of Tigard because the
safety and welfare of the police service dogs is required
for an efficient operation of the Police Department, therefore
an emergency ishereby declared to exist, and this ordinance
shall become effective immediately upon passage and approval
by the City CouncU.
