WHEREAS, the City of Tigard has adopted Ordinance No. 84-41 amending Section
7.32.080 of the Tigard Municipal Code requiring a permit to blast with
explosives: and
WHEREAS, the City Engineer is required by ordinance to investigate and
evaluate a blasting permit application; and
WHEREAS, Ordinance No. 84-41 does not address whether costs incurred in
investigating, evaluating and processing the application can be recovered; and
WHEREAS, Section 3.32 of the Tigard Municipal Code grants the City Council the
:authority to set rates for fees and charges by resolution; and
' wHEREAS, the effective date is to be December 1, 1984,
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
SECTION 1: Add the following language to Section 7.31.080(b) of the Tigard
Municipal Code:
(3) The applicant is to pay a fee as prescribed by the Tigard
City Council by Section 3.31 City Fees and Charges in the Tigard
Municipal Code.
SECTION 2: This ordinance shall be effective on and after the 1st day of
December, 1984.
