Ordinance No. 84-55 f. a CITY OF TIGARD, OREGON f ORDINANCE NO. 84- AN 4=AN ORDINANCE AMENDING THE TIGARD MUNICIPAL CODE CHAPTER 13.04 DEFINING WHEN INSTALLMENT PAYMENTS BECOME DELINQUENT, PROVIDING REMEDY; AND REQUIRING ASSESSMENTS TO BE PAID IN FULL THROUGH THE SALE OR TRANSFER OF OWNERSHIP OF PROPERTY OR THROUGH THE DIVISION OF LtxND WHEREAS, the Tigard Municipal Code does not delineate when assessments become delinquent, nor what happens when property changes owners and; WHEREAS, the Special Assessment Fund has been undercapitalized and; WHEREAS, the City of Tigard has cut-back in its staffing and; WHEREAS, the assumption of installment assessments requires staff time that is not recovered. THE CITY OF TIGARD ORDAINS AS FOLLOWS: Section 1. The Tigard Muncipal Cade Chapter 13.04 to be amended by adding Section 13.04.081 Procedure for collection on default to read as follows: Should the owner neglect or refuse to pay installments as they become due and payable for a period of one year, the City shall, by reason of such neglect or refusal to pay the instalments, and while the neglect and refusal to pay continues, pass a resolution giving the name of the owner then in default in the payment of the sums due, either principal or interest, together ,with a description of the property upon which the sums are owing and declaring the whole sum, both principal and interest due and payable at once. The Finance Director is then directed to proceed at once to collect all unpaid instalments and to enforce collection thereof, with all penalties added thereto, in the same manner as described in Section 13.04.080. Section 2. The Tigard Municipal Cade Chapter 13.04 to be amended by adding Section 13°04.087 Assessment balance due upon sale, the .division of landor transfer of property from one owner to another to read as follows: Assessments against property are allowed to be paid in installments by the owner of the property at the time of the assessment (ORS 223.210) Whenever the owner of property changes through the sale or transfer of land, or the division of land; the total assessment balance plus interest becomes due and payable at once.
