AN ORDINANCE AMENDING SECTIONS OF TITLE 13 OF THE TIGARD MUNICIPAL CODE AND
DECLARING AN EMERGENCY.

WHEREAS, the City of Tigard has pre-assessed local improvement districts for
purposes of providing Bancroft Bonding to participants; and
WHEREAS, the Tigard Municipal Code does not clearly state that the term
pre-assessment implies assessing properties based on the engineer's estimate;
and

WHEREAS, the City plans to continue using the pre-asssessment method of
completing local improvement districts.
THE CITY. OF TIGARD ORDAINS AS FOLLOWS:
Section 1. Adding to Section 13.04.010 a new definition:
- - (f) "Pre--assessment" means a method of assessing
properties for local improvement districts prior to
� ., construction of the project, based upon the engineer's
t estimate (either the City or consulting engineer)."
Section 2. Amending Section 13.04.080 first paragraph (underlined
to be added; [bracketed] to be deleted): "Upon signing
a contract or upon pre-assessment or upon a
determination by the City Council to make the
improvement under its own supervision by purchasing the
material and hiring labor, or as soon thereafter as is
reasonably convenient shall determine whether the
property benefited shall bear all or a portion of the
cost and shall direct the City Engineer to apportion and
assess the cost of making such improvement upon the
lots, parts of lots and parcels of land within the
assessment district in accordance with the special and
peculiar benefits derived by each lot, part of lot and
parcel of land."
Section 3. EFFECTIVE DATE AND EMERGENCY. Because of the possibility
of being unable to sell Bancroft Bonds after November,
1984 and to clarify the Tigard Municipal Code, an
emergency is declared and this ordinance shall be in
effect from and after July 9, 1984.
