AN ORDINANCE AMENDING SECTION 18.114.145 SIGNS, OF THE TIGARD COMMUNITY
DEVELOPMENT CODE; AND DECLARING AN EMERGENCY. 4
WHEREAS, the City of Tigard Community Development Code allows for exceptions
to the Sign Code (Chapter 18.114); and
WHEREAS, there are no clear standards currently in the Community Development
Code for approval or den'-al of Sign Code Exceptions.
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section 1: Section 18.114.145 shall be added to the Community Development Cude
as follows:
"18.114.145 Approval Criteria For Exceptions To The Sign Code.
"The Planning Commission shall approve, approve with conditions, or
deny a request for an exception to the sign code based on findings
at least one of the following criteria are satisfied:
"l. The proposed sign code exception is . necessary because a
conforming building er sign on an adjacent property would limit the
view of a sign erected on the site in conformance with the sign code
standards.
"2. The proposed exception to the height limits in the sign code is
necessary to make the sign visible from the street because of the
topography of the site.
"3. There is an access drive which services the business or service
from a street other than the street which it is located on."
Section 2. In order to provide clear direction for the interpretation of the
Tigard Municipal Code, and to protect the public health, safety and
welfare of the people of the City of Tigard, an emergency is hereby
declared to exist, and this ordinance shall become effective upon
its passage by the Council and approval by the Mayor.
