AN ORDINANCE DETERMINING THE FINAL COST OF SEWER IMPROVEMENTS IN THE S.W.
100th AVENUE SANITARY SEWER LOCA:. IMPROVEMENT DISTRICT, RATIFYING AND ADOPTING
THE APPORTIONMENT AND ASSESSMENT OF THE COST TO RESPECTIVE PARCELS OF LAND
WITHIN THE DISTRICT, SPREADING THE ASSESSMENT AND DIRECTING THE ENTRY OF
ASSESSMENTS IN THE LIEN DOCKET.
WHEREAS, the Council finds that by Ordinance No. 83-32 adopted on June 26,
1983, the Council authorized and directed that the sewer improvements within
the boundaries of the S.W. 100th Avenue Sanitary Sewer Local Improvement
District, as bounded and described in Resolution 83-44, be undertaken by
contract, and that that work has now been completed.
WHEREAS, the Council finds that the total final assessable costs of the
improvements within the boundaries of the Improvement District is the sum of
$9,324.99 and the Council further finds that all lots, parcels or parts of
lots within the boundaries of the District as defined in Resolution 83-44 are
specially benefited and together shall bear equitable shares of the cost of
the improvement.
WHEREAS, the Council further finds that the apportionment of the cost of the
improvement upon each lot, part of lot or parcel, as prepared by the City, and
as set forth on "Attachment A" entitled "Assessment For S.W. 100th Avenue
Sanitary Sewer Local Improvement District", which by reference is made a part
of this ordinance, is according to the special and peculiar benefits accruing
to each from the improvement.
A WHEREAS, the Council further finds that the City Recorder of the City of
Tigard has mailed or caused to be personally delivered to the owner of each
lot or tract proposed to be assessed a notice of assessment, which notice
stated the amount of the assessment proposed on that property and also stated
a date by which time objections should be filed with the City Recorder.

WHEREAS, the Council finds that at its regular meeting of January 16, 1984 the
City's final e3timates of assessments and all objections filed with the City
Recorder were duly considered, and the City Council at that time determined
the assessment to be properly apportioned according to the special and
peculiar benefits accruing to each parcel, part of lot, or lot within the
Improvement District.
NOW, THEREFORE,
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section 1: it is hereby determined that the total cost is $9,324.99 and that
the proportionate share of the cost of construction of the sanitary sewer on
each parcel of property adjacent to the sanitary sewer and benefited thereby
is the amount set forth on "Attachment A" entitled "Assessments For SW 100th
Avenue Sanitary Sewer Local Improvement District" and that each parcel of land
is benefited by the construction of the improvement, to the full extent of the
amount set opposite such parcel of land and that the respective amounts
represent the proportional benefit of said improvement to the respective
parcelsofland, and the Council does hereby declare that each of the parcels

of property described below is hereby assessed the amount set forth in
"Attachment A" entitled "Assessment For SW 100th Avenue Sanitary Sewer Local
Improvement District" for the cost of the construction of the improvement.
Section 2: The assessment of each parcel of land shall constitute a lien
against each property in the amount shown on "Attachment A" entitled
"Assessment for SW 100th Avenue Sanitary Sewer Local Improvement District".
Section 3: The City Recorder is hereby directed to enter a statement of the
several assessments in the docket of City Liens of the City of Tigard in the
amount shown on "Attachment A" entitled "Assessment For SW 100th Avenue
Sanitary Sewer Local Improvement District" and such assessments shall be
separate from other prior or subsequent assessments and the same shall
constitute a lien against each parcel and shall bear Interest at the annual
rate of thirteen (13) percent until paid.
