Ordinance No. 83-58 CITY OF TIGARD, OREGON
ORDINANCE NO. 83 - ,
AN ORDINANCE ADOPTING FINDINGS AND UPHOLDING THE PLANNING COMMISSION'S DENIAL
OF A COMPREHENSIVE PLAN MAP AMENDMENT AND ZONING DISTRICT MAP AMENDMENT (CPA
9-83 AND ZC 8-83 - GALLOS VINEYARD) AND DECLARING AN EMERGENCY.
WHEREAS, the Tigard Planning Commission denied a comprehensive plan amendment
and a zoning district amendment request for the property owned by Herb
Morrisette Builders at a public hearing on August 30, 1983; and
WHEREAS, the applicant representing Gallos Vineyard appealed the decision of
the Planning Commission; and
WHEREAS, a public hearing was held before the City Council on November 7,
1983; and
WHEREAS, the Tigard City Council upheld the decision of the Planning
Commission after considering the comments of the Planning Commission and
individual citizens, and voted to uphold the Planning Commission denial of the
Comprehensive Plan amendment as proposed and the Zoning District Map amendment
as proposed.
NOW, THEREFORE,
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section l: - The City Council adopts findings in this case as follows:
1. The change of land use designation on this property from low density
residential to medium density residential would result in a use which
is incompatible with the uses of the immediately surrounding area.
2. The proposed use does not meet the locational criteria established in
the adopted Comprehensive Plan.
Section 2: The City" Council, therefore, upholds the Planning Commission's
denial of the Comprehensive Plan amendment and Zoning District
Map amendment as proposed.
Section 3: Inasmuch as it is necessary to resolve the appeal in a timely
manner, an emergency is declared to exist and this ordinance
shall become effective upon its passage by the Council and
approval by the Mayor.
