Ordinance No. 83-36 f CITY OF TIG:"-D, OREGON ' ORDINANCE NO. 83-jj�,_ t k: AN ORDINANCE PROVIDING PROCEDURES FOR COLLECTION OF SEWER USER CHARGES, i IDENTIFYING THOSE RESPONSIBLE FOR PAYMENT AND DECLARING AN EMERGENCY. WHEREAS, the City of Tigard through an agreement dated September 8, 1970, has been recognized as a billing agent for Unified Sewerage Agency for the collection of sewer user charges, and WHEREAS, this agreement states that sewer user rates are determined by Unified Sewerage Agency and prescribes the percentage of user fee that is owed to the Agency, but does not specify the method of collection. The City of Tigard ordains as follows: Section 1. The City of Tigard, as billing agent for Unified Sewerage Agency, prepares billings on a quarterly basis to sewer users. The person who owns the property served by the sewerage system shall be responsible for payment of the sewer user charge for that property notwithstanding the fact that the property may be occupied by a tenant or other occupant who may be required by the owner to pay said charges. ORS 454.225 Section 2. The City of Tigard will bill property owners for sewer services, but may bill an alternate party (tenant, trustee, agent, etc.), upon receiving written notice from the property owner. The City shall be held harmless in any disputes between landlord and tenant regarding the collection of delinquent sewer services. Section 3. The date of billing shall be the 1st day of the month for which the sewer user charge is calculated. Section 4. Sewer user charges shall be due and payable to the Finance Director no later than 30 days after the date of billing. Unpaid charges after this date shall be deemed delinquent and together with interest, costs and penalties may be recovered in an action at law by the City of Tigard. Section 5. In accordance with the Fees and Charges Ordinance of the City and ORS 454.225, the City will accrue_ penalties, interest and costs on delinquent accounts and on or before July 15 certify to the Washington County Tax Assessor the delinquent amounts to be added to the tax roll next prepared. ' Section 6. Change of occupancy of premises found delinquent shall not be cause for reducing or eliminating these penalties. Section 7. Because of the need to formalize the collection process of sewer user charges in conformance with past practise, an emergency ; ) declared and this ordinance shall be effective upon its passage and signature of the Mayor.
