ORDINANCE NO. 52-33
AN ORDINANCE FOR: ADDITION TO CHAPTER 12, TIGARD MUNICIPAL CODE. RELATING TO
SEWER CONNECTION SURCHARGE FEE IN LIEU OF ASSESSMENT FOR CONNECTION TO
SANITARY SEWER: WITHIN CITY LIMITS ARID DECLARING All EMERGENCY.
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section l: That Chapter 12 of the Tigard Municipal Code, be amended to read
as follows:
The applicant for sewer connection to serve previously unassessed
property or property which has not in any way previously
contributed, either directly or indirectly, to the construction of
a public sewer line adjacent to, abutting, running through or
directly serving said property, shall pay, in addition to the
con-.ectio-. ahavgea aet forth by the Unified Sewerage Agency and
deemed payable to the City of Tigard by contractual agreement, the
following surcharge connection fees:
An amount per duelling unit, as defined in the above
mentioned contractual agreement with Unified Sewerage Agency,
computed annually as the average dwelling unit cost For
similar sewers serving similar properties for which
assessments were charged during the previous two calendar
yarns. The current surcharge, as of 6/30/92. based upon
typical projects for the two previous years shall be
$3,000.00, in addition to hookup fees.
},. Section 2: That inasmuch as the need for a uniform policy concerning the
applicability of the foregoing provisions to certain tracts of
land desiring to connect to the sewer system of the City of
Tigard, and inasmuch as it is necessary for the peace, health and
safety of the people of the City of Tigard that such uniform
policy be initiated and said provisions clarified with than least
possible delay in order to provide continuity of saver services,
assure public revenues and proper use of public property of the
City, it is declared that an emergency exists, had this ordinance
;. shall be in full force and effect upon its passage by the Council
and approval by the Mayor.
