CITY OF TIGARD, OREGON
ORDINANCE No. 82--i±—
AN ORDINANCE AMENDING TIGARD MUNICIPAL CODE CHAPTER 18.57, SENSITIVE LANDS, AND
DECLARING AN EMERGENCY.
WHEREAS, the Tigard City Council finds that the Federal Emergency Management
Agency (FEMA) has requested some clarification in language in the Sensitive Lands
Ordinance, Tigard Municipal Code Chapter 18.57, of the City of Tigard; and
WHEREAS, the Tigard City Council is willing to qualify for and meet the
Federal Flood Insurance Regulations by clarifying the language in Chapter 18.57
of the Tigard Municipal Code.
NOW, THEREFORE,
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section 1: The Tigard City Council amends the following sections of the
Tigard Municipal Code in Chapter 18.57, Sensitive Lands, as follows:
18.57.020 Definitions. (to be inserted in alphabetical order in
this section):
" "Habitable Structure" means any structure usable for living purposes,
which includes working, sleeping, eating, cooking or recreation or
a combination thereof. A structure used only for storage purposes
is not a "Habitable Structure". "
18.57.040 Uses And Activities Allowed With A Special Use Permit.
2 A) ' Any temporary structure which is not habitable and by its
nature, can be readily removed from the floodplain area during periods
of flooding, and which would impede or interfere with the flow of
waters within the district,"
Section 2: Whereas, the immediate operation of the provisions of this ordinance
is necessary for the preservation of the public peace, health, and
safety, an emergency is hereby declared to exist, and this ordinance
shall be effective upon its passage by the Council, and approval by
the Mayor.
PASSED: By the Council, by unanimous vote of all Council members present,
after being read two times by number and title only, this ay day
