Ordinance No. 82-11 CITY OF TIGARD, OREGON ORDINANCE No. 82-11 AN ORDINANCE ADOPTING FINDINGS WITH RESPECT TO AN APPLICATION FOR A COMPREHEN- SIVE PLAN REVISION TO THE 1974 NPO ##1 PLAN POLICY 28 OF THE CITY OF TIGARD DECLARING AN EMERGENCY AND FIXING AN EFFECTIVE DATE. ASH AVENUE Tax Map: 2S 2AC, - Public Right-Of-Way, - Project Address: S.W. Ash from Hill to Burnham File Number: CPR 16-81, - Applicant: City of Tigard THE CITY OF TIGARD ORDAINS AS FOLLOWS SECTION 1: Finding that Policy 28 of the adopted NPO ##1 Plan now reads: "Policy 28. Ash Avenue should be extended across Fanno Creek, enabling access to Me Neighborhood's Commercial area without using Pacific Highway. Design features should be used to slow traffic and make the street as safe as possible.", and further findings that pursuant to procedures, the abovestated application for a Comprehensive Plan Revision was presented at a public hearing held by the Tigard Planning Commission on January 12, 1982. All interested persons were afforded an opportunity to be heard at this public hearing, Therefore, the Council adopts the following substantive finding: A. That the proposed Comprehensive Plan Amendment will benefit the surrounding neighborhood as determined by the Tigard City Council. SECTION 2: Therefore, pursuant to the requirements of Chapter 18.88 of the Tigard Municipal Code, this request for a Comprehensive Plan Revision of the NPO ##1 Plan Policy 28 of the City of Tigard is hereby approved subject to Prov inions of Chapter 18.88 of the Tigard Municipal Code as embodied in adopted Exhibits attached and made a part of this Ordinance. The NPO #r`1 Policy 28 is hereby changed to read as follows: Policy 28: Ash Avenue should be extended across Fanno Creek, enabling access to the neighborhoods commercial area without using Pacific Highway. Design features shall be used to slow traffic and make the street as safe as possible. Ash Avenue shall be designated a minor collector in conformance with the Comprehensive Street Plan. Design features and mitigation measures shall hold traffic volumes to the middle limits of a minor collector. Improvements to S.W. Ash Avenue from S.W. Hill to Fanno Creek shall be constructed as condition of development of adjacent properties. The street improvements along with the development of a major commercial site will increase traffic on Ash. A barricade shall be placed at Hill Street approximately at the end of existing pavement to protect the neighborhood residents from the commercial traffic. --The extension of Ash Avenue from the creek to S.W. Burnham will further,increase traffic volumes VC s i Methods of mitigating the traffic impact on the neighborhood shall include in the following order of improvement construction: 1. Improving S.W. McDonald Street to interim maintenance standards to encourage traffic from South of McDonald to use McDonald to exit to Hall and/or Pacific Highway. 2. improvements to the residential portion of Ash from Hill to Frewing. These improvements could include limited parking, delineation of traffic lanes and sidewalks on one or both sides of the street. _ 3. The extension of S.W. Hill to S.W. O'Mara and/or the improvement of S.W. Ash from Frewing to Garrett. 4. The extension of S.W. O'Mara to S.W. Hill parallel to S.W. Ash. E 5. Removal of the barricade in place on Ash rven11e at S.W. Hill. y s 6. Improvement of S.W. O'Mara Street to interim maintenance standards to encourage an alternate route. s 7. Installation of traffic inhibitors to the residential portion of Ash if and when traffic volumes exceed the middle range I for a minor collector. Traffic inhibitors include but are not limited to planting islands, speed bumps, buttons, turn' ing restrictions, load limits and enforcement. SECTION 3: Inasmuch as it is necessary to the peace, health, and safety of the public that the foregoing zone change in the City's records become effective, an emergency is hereby declared to exist, and this ordinance shall be effective upon its passage by the Council and approval by the Mayor.
