Ordinance No. 82-04 CI`iY OF TIGARD, OREGON a<- ORDINANCE NO. 8 2— Cil AN ORDINANCE AMENDING CHAPTER 1.8.57, TIGARD MUNICIPAL CODE RELETTING TO FLOODPLAIN DISTRICTS AND FIXING AN EFFECTIVE DATE. The City of Tigard ordains as follows: SECTION 1. Chapter 18.57, Sensitive IKands, of the Tigard Municipal Code is amended to read as follows: (a) 18.57 MO Floodplain District: The floodplain District identified by t>le Fe'dera Insuranc'e Administration in a scientific and engineering report entitled "The Flood Insurance Study for the City of Tigard, Oregon" dated September 1, 1981 with accompanying Flood Insurance Rate Maps and Flood Boundary _ Floodway Maps is hereby adopted by reference and declared to be a part of this Chapter. The Flood Insurance Study is on file in the Office of the City Recorder at Tigard City Hall. This section does not imply that land outside the area of Floodplain Districts or uses permitted within such districts will be free from flooding or flood damages. (b) Section. 18.57.020 Definitions is amended to include the following definition in alphabetical order in the existing listing in that Section: "'Development' means construction of a building including modular or mobile hones or any alternation or modification thereof, filling, excavating, paving, mining, dredging or grading. (Ref. 18.57.050 Floodplain District.) (c) Section 18.57.060 shall be amended to read as follows: "18.57.060 Sensitive Lands Permit A sensitive lands permit shall be obtained before development begins within the floodplain district as established in Section 18.57.080. Application for a Sensitive Lands Permit shall be made on forms furnished by the Planning Director. In accordance with the procedures and requirements set forth in Chapter 18,84 of this code, an application for a Sensitive Lands Permit filed as by said chapter stated may be approved or denied by the approval authority following a public hearing. All applications for a Sensitive Lands Permit shall. be supported by the following information to enable the approval. authority to determine whether the proposed use is located .in floodplain, drainageway or steep slope areas: {l) Floodplain; (A) Plans drawn to scale, submitted in triplicate as prepared by a registered professional engineer with experience in hydraulic and geohydrologic engineering } i and processes, showing the nature, location, { dimensions, elevations and topography of the site; the location of existing and proposed structures located upon the site, existing and proposed areas to be filled or otherwise modified, and the relation- ship of these to the location of the stream channel, and proposed methods for controlling erosion. 4 (B) Any docullentation, photographs, water marks, and similar evidence offered in support of the claim that the site or area in question lies above high water as defined by the regulatory flood. E : (2) Drainageways: (A) Plans drawn to scale, submitted in triplicate as } prepared by a registered professional engineer with ex- perience in hydraulic and hydrologic engineering and processes, showing the nature, location, dimensions, elevations and tcpogiaP1iy of the site; and location of existing and proposed structures located upon the site, existing and proposed fill or excavated areas, and the relationship of these to the location of the stream channel (if any), and the proposed methods of controlling erosion. (3) Steep slopes: (A) Plans drawn to scale, submitted in triplicate as prepared by a qualified registered professional engineer ; ' showing the nature, location, dimensions, elevations, and topography of the site; the location of existing and proposed structures located upon the site, existing and proposed fill or excavated areas and proposed methods of controlling erosion, i (d) 18.57.090 Federal Flood Insurance Program On March 1, 1982, the City of lg�' ^a'rc becomes elzgib e or t e r- egu7ar Federal Flood Insurance i Program. The following regulations are hereby adopted as required in [ 18,10.3(d) of the National Flood Insurance Program Regulations: . t ' 1. A '0' foot floodway shall be adopted by the City of Tigard . for the purposes of implementing the Federal Flood Insurance Program. 2. The City Recorders Office shall be responsible to obtain and F maintain the following information: (a) The actual elevation (in relation to mean sea level) of i x� the lowest habitable floor (including basement) of all g new or substantially improved structures, and whether or not the structure contains a basement, ° (b) For all new substantially improved flood proofed .structures: r ;r (1) Verify,and record the actual elevation (in relation Page 2 ORDIMMENO. 82 ,� to mean sea level); and (2) Maintain flood proofing certifications. (c) Maintain for public inspection all records pertaining to the provisions of this ordinance. SECTION 2. This ordinance shall take effect on the 30th day following its passage and signing.
