AN ORDINANCE AMENDING SECTION 7.'40.070-NOISE OF THE TIGARD MUNICIPAL
CODE BY ADDING RESTRICTIONS ON THE USE OF PORTABLE SOUND AMPLIFYING
EQUIPMENT.
WHEREAS, it has come to the attention of the City Council that
the use of portable sound amplifying equipment has increased, and
that its use has great potential for amounting to a nuisance affect-
ing the welfare of the general public, and
WHEREAS, Section 7. 40.070, while dealing with noise nuisances
generally, does not refer explicitly to the use of portable sound
amplifying equipment;
NOW, THEREFORE, the City of Tigard does ordain as follows:
Section 1: Section 7.40.070-Noise of the Tigard Municipal Code
isereby amen-ced b-y—t-he addition of a new subsection
(g) and the relettering of the former section (g) . Subsections (g)
and (h) of Section 7.40.070-Noise of the Tigard Municipal Code shall
now read as follows:
(g) No person shall cause or permit noise to
emanate from sound amplifying equipment under his
or her controls so as to cause the ambient noise
level to exceed 60 DBA at any distance 100 feet or
more from the source between the hours of 7:00 a.m.
and 10:00 p.m. and 55 DBA 100 feet front the source
between the hours of 10:00 p.m. and 7:00 a.m.
(h) Violation of this section is a Class C
misdemeanor.
This ordinance shall become effective upon the 31st day
following its passage and signature by the Mayor.
