Ordinance No. 81-26 t CITY OF TIGARD, OREGON ORDINANCE NO. 81-� AN ORDINANCE ADOPTING FINDINGS WITH RESPECT TO AN APPLICATION FOR A COMPREHENSIVE PLAN REVISION TO THE 1978 NPO #4 PLAN MAP OF THE CITY OF TIGARD DECLARING AN EMERGENCY AND FIXING AN EFFECTIVE DATE. THE CITY OF TIGARD ORDAINS AS FOLLOWS SECTION l : Finding; that the lands hereinafter described are now classified as R-7 Single family residential and further findings that pursuant to procedures , the abovestated application for a Comprehensive Plan Revision was presented at a public hearing held by the Tigard Planning Commission on April 7, 1981 . All interested persons were afforded an opportunity to be heard at this public hearing. There- fore, the Council adopts the following substantive finding: A. That the proposed zoning is compatible with the surrounding neighborhood as determined by the Tigard Planning Commission. SECTION 2 : Therefore, pursuant to the requirements of Chapter 18.88 of the Tigard Municipal Code, this request for a Compre- hensive Plan Revision of the NPO #4 Plan itap of the City of Tigard is hereby approved subject to provisions of Chapter 18.40 of the Tigard Municipal Code as embodied in adopted Exhibits "A", B", and "C" attached and made a part of this ordinance. The zoning designation of the subject property is hereby changed to Commercial Professional . Exhibit "A": Legal Description - Exhibit "B": Tax Map - Exhibit "C" Staff Report SECTION 3: Inasmuch as it is necessary to the peace, health, and safety of the public that the foregoing zone change in the City's records become effective, an emergency is hereby declared to exist, and this ordinance shall be effective upon its passage by the Council and approval by the Mayor. LOCATION: On Hampton Street between 70th and 72nd (Wash. Co. Tax Map 2S1 IAC, Tax Lots 1100, 1200, 1300) . - FINDINGS OF FACT: 1. At the present time, these parcels are designated Protected/Residential R-7 "Single Family Residential" on the Comprehensive Plan and are included in Conversion Unit #5. C 2. The adopted NPO #4 Plan states: "In the Triangle, the most viable residential areas have been identified and are slated for protection until 75% of the owner occupants elect to allow their "conversion unit" to be redeveloped according to the uses specified on the Plan Map. The conversion units are also delineated on the Plan Map." 3. The NPO #4 membership passed the following motion at their meeting on February 4, 1981: "That a Comprehensive Plan Change be initiated by City Staff to change the Zone from R-7 Protected Single Family Residential to Commercial Professional for those lots abutting Hampton which shall be designated by the Lot and Map #2S1 IAC, 1100, 1200, 1300 and that at the Site Design Review level, berms shall be added to the north of the properties and that no variance to the 35 foot height limitation shall be allowed." 4. This request is logical considering that Commercial Professional development has tarsen place at the corner of Hampton and 72nd avenue, Tax Lots 1400 and 1500. The primary concern is to protect the residential area abutting Gonzaga Street. Mote the NPO Motion concerning Site Design Review criteria. CONCLUSIONARY FINDINGS: u 1. To comply with the wishes of the citizens who drafted the NPO #4 Flan, it seems logical that this request be granted.
