Ordinance No. 79-30 CITY OF TIGARD, OREGON ORDINANCE No. _- ,3G AN ORDINANCE RATIFYING, CONFIRMING AND RECORDING CHANGE IN THE BOUNDARIES OF THE CITY OF TIGARD BY THE BOUNDARY COMMISSION, ORDER No. 1' 81_ , INVOLVING LANDS OF LAMMERMAN ANNEXATION, SECTION 3, TOWNSHIP 2 SOUTH, RANGE 1WEST, WILLAMETTE MERIDIAN, WASHINGTON COUNTY, OREGON, RECORDING EFFECTIVE DATE AND DECLARING AN EMERGENCY. WHEREAS, the Boundary Commission established pursuant to Chapter 494 Oregon Laws of 1969 for the Portland Metropolitan Area, by its final order dated February 8, 1979 approved the hereinafter described change in f the boundaries of the City of Tigard, and a copy of said final order has been filed with the City Recorder. t F NOW, THEREFORE, THE CITY OF TIGARD ORDAINS AS FOLLOWS: Sectior. 1: That the final order of the Boundary Commission adopted on the , __ath_ day of February, 1979 a copy whereof is hereto attached and by this reference made a part hereof, be, and the same is, hereby ratified, confirmed and adopted by reference to the same Legal force and effect as if set forth herein in full. i Section_2: That the boundaries of the City of Tigard be, and they are hereby, changed to include the lards as described in the within order of the Boundary Commission, and the corporate limits of the City of Tigard are hereby changed in conformity therewith. '; Section 3: That the Recorder of the City of Tigard be, and she is hereby, directed to forthwith file a copy of this ordinance, including a copy of said Order, in the following offices: (a) Secretary of State (b) Department of Revenue and Taxation, Washington County (c) Department of Records and Elections, Washington County (d) Department of Public Works, Attention: Surveyor, Washington County Section 4: That the City Planning Commission be, and it is hereby, authorized and directed to conduct such proceedings as may be necessary to conform the authorized zoning and land use of the described premises to the 'requirements of the City's Zoning Map and Code. t: Section 5: Inasmuch as it is necessary for the peace, health and safety of the people of the City of Tigard that the foregoing change in the boundaries of the City become a permanent part of the City'srecords, an emergency is hereby declared to exist, and this ordinance shall be effective upon its passage by the Council, and approval by the Mayor. Stark - (#530) - Portland, Ore. 97204 - Tel: 229-5307 FINAL ORDER RE: BOUNDARY CHANGE PROPOSAL NO. 1381 - Annexation of territory to the City of Tigard Proceedings on Proposal No. 1381 commenced upon receipt by the Boundary Commission of a petition from property owners on January 8, 1979 requesting that certain property be annexed to the city. The petition meets the requirements for initiat- ing a proposal set forth in ORS 222.170 and paragraph (a) Section (4) of ORS 199.490. Upon receipt of the petition the Boundary Commission published and posted notice of the public hearing in accordance with ORS 199.463 and conducted a public hearing on the proposal on February 8, 1979. The Commission also caused a study to be made on this proposal which considered economic, demographic and sociological trends and project-.ons and physical development of the land. FINDINGS On the basis of the public hearing and the study the Boundary Commission found that: 1. The territory to be annexed is contiguous to the city and contains 2.94 acres, 3 single family residences, a population of 11, and is evaluated at $123,300. 7 2. The petitioners desire city services to facilitate development of the rear of the parcels. 3. The owner of Tax Lot 4500 is not a consenting party. He says he has no intent of further developing his parcel. 4. The cityls plan designates the site Suburban Low Density Residential providing for 3 units per acre, or a potential of 4 new units on the two consenting parcels. S. The Washington County Comprehensive Pian designates the area Urban. 6. The regional plan designates the territory Urban and within the Interim i Immediate Growth boundary. 7. The proposal complies with all applicable LCDC goals. 8. The territory is within the Tigard Water District which can provide adequate service from a 12-inch main located in 121st Ave. on a 6-i.nch main in Terrace Trails. 9. The territory is within the boundaries of Tualatin RFPD which also serves the city. 11. polio', parks, libraries, street maintenance, street lighting, and other services will be available from the city uyo..., annexation. REASONS FOR DECISION s On the basis of the findings the Commission determined that; 1. The property owners desire municipal services which only the city has , available. E 2. The proposed development is in conformance with applicable city, county, and regional planning, and with LCDC goals. 3. All municipal services necessary for development are available from the city or from special districts of which the city and the territory to be annexed t are a part.
