ORDINANCE NO. 79- 15
AN ORDINANCE AMENDING COMPREHENSIVE PLAN ADDING THE "BOAT SALES AND REPAIR"
IN THE C-3M "MAIN STREET COMMERCIAL" ZONE AND THE ASH AVENUE-DOWNTOWN
PLANNING AREA.
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
SECTION 1: The City Council finds that it is necessary, expedient and for
the best interest of the people of the City of Tigard that the
Comprehensive Plan (Neighborhood Plan Organization #1) be revised so as to
attain the purpose and the objectives of ORS Chapter 197 and ORS Chapter
227 insofar as applicable with the respect to the Ash Avenue-Downtown
planning area.
SECTION 2: The Council further finds that amendment of the Neighborhood Plan
#1 is necessitated by changes which have occurred affecting the
property which, was described to restrict boat sales and repair facilities.
It has been reviewed at public hearings of the NPO #1 Plan Committee and the
Planning Commission at the January 16, 1979, meeting in reference to adding
the boat sales and repair as a conditional use in the C-3M "Main Street
Commercial" area. The attached Exhibit A� depicts the subject property in

question as to the boat sales and repair use in the "Commercial Main Street"
designated area; this exhibit by reference is made in part herein. a
SECTION 3: The City Council further finds that pursuant to ORS 227.250 the
Planning Commission, after due and legal notice held a public
hearing in the Lecture of Fowler Junior High School, Tigard, Oregon, on
January 16, 1979 where all interested persons were given the opportunity to
be heard. The report of this meeting being forwarded to the City Council
for their consideration on this matter. Furthermore, after due and legal `
notice, a public hearing was held in the Lecture Room of Fowler Junior High
School, Tigard, Oregon, on February 26, 1979, at 8:00 P.M. by the City
Council at which time an oral presentation and exhibits were displayed of the
plan was given, and all interested persons were afforded an opportunity to
be heard with respect thereto and to comment thereon. �
SECTION 4: This ordinance shall be effective on and after the 31st day after
its passage by the Council and approval of the Mayor.
