Ordinance No. 79-102 CITY OF TIG^.RD, OREGON ORDINANCE No. AN ORDINANCE RATIFYING, CONFIRMING AND RECORDING CHANGE IN THE BOUNDARIES OF THE CITY OF TIGARD BY THE BOUNDARY COMMISSION, ORDER No. 1452 , INVOLVING LANDS OF SOFOS, NE QUARTER OF SEC. 1, TOWNSHIP 2 S, RANGE 1 WEST, WILLAMETTE MERIDIAN, WASHINGTON COUNTY, OREGON, RECORDING EFFECTIVE DATE AND DECLARING AN EMERGENCY. t WHEREAS, the Boundary Commission established pursuant to Chapter 494 Oregon Laws of 1969 for the Portland Metropolitan Area, by its final order dated __Au¢„G30� 1979 ' approved the hereinafter described change in the boundaries of the City of Tigard, and a copy of said final order has been filed with the City Recorder. NOW, THEREFORE, THE CITY OF TIGARD ORDAINS AS FOLLOWS: Section 1: That the final order of the Boundary Commission adopted on the 30th day of August= 1979 , a copy whereof is hereto attached and by this reference made a part hereof, be, and the same is, hereby ratified, confirmed and adopted by reference to the same legal force and effect as if set forth herein in full. Section 2: That the boundaries of the City of Tigard be, and they are hereby, changed to include the lands as described in the within order of the Boundary Commissioa, and the corporate limits of the City of Tigard are hereby changed in conformity therewith. Section 3: That the Recorder of the City of Tigard be, and she is hereby, directed to forthwith file a copy of this ordinance, including a copy of said Order, in the following offices: (a) Secretary of State (b) Department of Revenue and Taxation, Washington County (c) Department of. Records and Elections, Washington County (d) Department of Public Works, Attention: Surveyor, Washington County Section 4: That the City Planning Commission be, and it is her-by, authorized and directed to conduct such proceedings as may be n,_cessary to conform cne authorized zoning and land use of the described premises to the requirements of the City's Zoning Map and Code. Section S: Inasmuch as it is necessary for the peace, health and safety of the people of the City of Tigard that the foregoing change in the boundaries of the City become a permanent part of the City's records, an emergency is hereby declared to exist, and this ordinance shall be effective upon its passage by the Council, and approval by the Mayor. W. Stark (#530) - Portland, Ore. 97204 Tel: 229-5307 FINAL ORDER RE: BOUNDARY CHANGE PROPOSAL NO. 1452 - Annexation of territory to the City of Tigard. Proceedings on Proposal No. 1452 commenced upon receipt by the Boundary Commission of a resolution and property owner consents from the City of Tigard on June 21, 1979, requesting that certain property be annexed to the city. The resolution and property owner consents meets the requirements for initiating a proposal set forth in ORS 222.170 and Section (4) of ORS 199.490. Upon receipt of the resolution and property owner consents the Boundary Commission' published and posted notice of the public hearing in accordance with ORS 199,463 and conducted a public hearing on the proposal on August 30, 1979. 'The Commission also caused a study to be made on this proposal which considered economic, demo- grhphic and sociological trends and projections and physical development of the land. FINDINGS On the basis of the public hearing and the study the Boundary Commission found that: 1. The territory to be annexed is contiguous to the city and contains 2.81 acres, 3 single family residences, an estimated population of 9, and is evaluated at $79,200. 2. 1'he property owners desire city services to facilitate development of the territory. Interest in a multi-family development was expressed, 3. The territory is designated Urban on the regional plan and is within the Interim Immediate Growth Boundary. 4. The territory is designated Urban on the county Framework Plan. Current county zoning is RU-4. 5. The city's NPO Plan #4 designates the territory as Urban Low Density Residential, The density provision for this plan designation is a maximum of 4 units per acre. The corresponding city zone is R-7 which has a provision for duplexes under a conditional use permit. 6. The proposal conforms with LCDC Goals #1, 2, 3, 4, 10, 11, 12, 13 and 14. Goals #5 - 9 and 15 - 19 do not apply here. 7. The city has an 8-inch sewer main located in SW 72nd approximately 250 feet .` south of the territory capable of providing gravity service to the property. Extension costs would be borne by the property owner, 8. The territory is within the boundary of the Metzger Water District and the Tualatin RFPD. These services will not be adversely affected by the annexation. The water district can provide service from a 12-inch main located in S11 72nd Ave. fronting the territory. Page 1 - FINAL ORDER 9. Police protection and other services will be available from the city upon annexation. REASONS FOR DECISION On the basis of the findings the Commission determined that: 1. The proposal is an incremental step toward annexation of the entire area surrounded by Tigard. Service efficiency and economy will be improved by annexation of the area. 2. The proposal conforms with city, county and regional planning for the area and with applicable LCDC Goals. 3. A full range`of urban service will be available upon annexation. ORDER On the basis of the findings and reasons listed above the Boundary Commission ' approved BOUNDARY CHANGE PROPOSAL NO. 1452 on August 30, 1979. NOW THEREFORE IT IS ORDERED THAT the territory described in Appendix "A" and depicted on the attached map, be annexed to the City of Tigard as of this date.
