AN ORDINANCE RATIFYING, CONFIRMING AND RECORDING CHANGE IN THE BOUNDARIES OF THE
CITY OF TIGARD BY THE BOUNDARY COMMISSION, ORDER No. 1451 , INVOLVING LANDS OF
CENTURY 21,NE QUARTER OF SEC. 1, TOWNSHIP 2 S, RANGE TWn7,-RILLAMETTE MERIDIAN,
WASHINGTON COUNTY, OREGON, RECORDING EFFECTIVE DATE AND DECLARING AN EMERGENCY.
WHEREAS, the Boundary Commission established pursuant to Chapter 494
Oregon Laws of 1969 for the Portland Metropolitan Area, by its final order
dated August 30, 19.79 approved the hereinafter described change in
the boundaries of the City of Tigard, and a copy of said final order has been
filed with the City Recorder.
NOW, THEREFORE,
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section 11: That the final order of the Boundary Commission adopted on the
30 day of August, 1979 , a copy whereof is hereto
attached and by this reference made a part hereof, be, and the same is, hereby
ratified, confirmed and adopted by reference to the same legal force and effect
as if set forth herein in full.
Section 2: That the boundaries of the City of Tigard be, and they are hereby,
changed to include the lands as described in the within order of the
Boundary Commission, and the corporate limits of the City of Tigard are hereby
changed in conformity therewith.
Section 3: That the Recorder of the City of Tigard be, and she is hereby,
directed to forthwith file a copy of this ordinance, including a
copy of said Order, in the following offices:

(a) Secretary of State
(b) Department of Revenue and Taxation, Washington County
(c) Department of Records and Elections, Washington County
(d) Department of Public Works, Attention: Surveyor,
Washington County
Section 4: That the City Planning Commission be, and it is hereby, authorized
and directed to conduct such proceedings as may be necessary to
conform the authorized zoning and land use of the described premises to the
requirements of the City's Zoning Map and Code.
Section 5: Inasmuch as it is necessary for the peace, health and safety of the
people of the City of Tigard that the foregoing change in the
boundaries of the City become a permanent part of the City's records, an emergency
is hereby declared to exist, and this ordinance shall be effective upon its passage
by the Council, and approval by the Mayor.

FINAL ORDER
RE: BOUNDARY CHANGE PROPOSAL NO. 1451 Annexation of territory
to the City of Tigard.
Proceedings on Proposal No. 1451 commenced upon receipt by the
Boundary Commission of a resolution and yr:,kert,,.., ..c..id-n._-

from the City of Tigard on .lune 21, 1979 requesting that certain
property be annexed to the city. The resolution and property-
owner
ropertyowner consents meet the requirements for initiating a proposal
set forth in ORS 222.170 and Section (4) of ORS 199.490.
Upon receipt of the resolution and property owner consents, the .
Boundary Commission published and posted notice of the public
hearing in accordance with ORS 199.463 and conducted a public
hearing on the proposal on August 30, 1979. The Commission
also caused a study to be made on this proposal which considered
economic, demographic and sociological trends and projections
and physical development of the land.
FINDINGS
On the basis of the public hearing and the study, the Boundary 1
Commission found that:
1. The territory to be annexed is contiguous to the city and
contains . 50 acres , is vacant, and is evaluated at $90,000.
2 The property owner desires annexation to obtain city services
to facilitate development. The site is proposed to be part
of. a Commercial Office Park.
3. The city's NPO Plan #4 designates the territory as "Office
Park".
4. The county plan designates the site as urban. Current county
zoning is B-4.
5. The MSB Land Use Framework Element designates the territory
Urban and includes it within the Interim Immediate Growth
Boundary.
6. The proposal conforms with LCDC Goals #l, 2, 3, 4 , 9, 11, 12,
13 and 14. LCDC Goals #5-8,10 and 15-19 do not apply here.
7. The city has an 8-inch collector sewer line in SW Franklin
500 feet south of thepropertycapable of providing gravity
service to the property.
8. The territory is within the boundary of the Metzger Water

_ M District and the Tualatin RFPD, These services will not be
adversely affected by the annexation. The water district
can provide service from an 8-in main located in SW 68th Ave.
9. Police protection and other services will be available from
the city upon annexation.

1. The property owner desire city services to facilitate
development of the territory.
Z. The proposed action is in conformance with Tigard City Planning
as well as , Washington County and regional planning.
3. The proposal conforms with all applicable LCDC goals .
4. Upon annexation, a full range of urban services will be
available from the city.
5. The proposal is an incremental step towards annexation of the
entire triangle area and "rounding out" the city boundary.
Service efficiency and economy will be improved by annexation
of the area.

Commission approved BOUNDARY CHANGE PROPOSAL N0, 1451 on August 30,

NOW THEREFORE IT IS ORDERED THAT the territory described in Appendix
"A°' and depicted on the attached map , be annexed to the City of
Tigard as of this date.
