Ordinance No. 79-03 CITY OF TIGARD, OREGON ORDINANCE No. 79 AN ORDINANCE RATIFYING, CONFIRMING AND RECORDING CHANGE IN THE BOUNDARIES OF THE CITY OF TIGARD BY THE BOUNDARY COMMISSION, ORDER No. 1324 , INVOLVING LANDS OF 114TH AVENUE ANNEXATION - SECTION 10, TOWNSHIP 2 SOUTH, RANGE 1 WEST, W.M., WASHINGTON COUNTY, OREGON, RECORDING EFFECTIVE DATE AND DECLARING AN EMERGENCY. WHEREAS, the Boundary Commission established pursuant to Chapter 494 Oregon Laws of 1969 for the Portland Metropolitan Area, by its final order dated October 18 1278 approved the hereinafter described change in the boundaries of the City of Tig; rd, and a copy of said final order has been filed with the City Recorder. NOW, THEREFORE, THE CITY OF TIGARD ORDAINS AS FOLLOWS: Section 1: That the final order of the Boundary Corunissi.on adopted on the 18th day of October, 1978 _ , a copy whereof is hereto attached and by this reference made a part hereof, be, and the same .is, hereby ratified, confirmed and adopted by reference to the same legal force and effect as if set forth herein in full. Section 2: That the boundaries of the City of Tigard be, and they are hereby, changed to include the lands as described in the within order of the Boundary Commission, and the corporate limits of the City of Tigard are hereby changed in conformity therewith. Section 3: That the Recorder of the City of Tigard be, and she is hereby, directed to forthwith file a copy of this ordinance, including a copy of said Order, in the following offices: (a) Secretary of State (b) Department of Revenue and Taxation, Washington County (c) Department of Records and Elections, Washington County (d) Department of Public Works, Attention: Surveyor, Washington County Section on 4_ That the City Planning Commission be, and it is hereby, authorized and directed to conduct such proceedings as may be necessary to conform the authorized zoning and land use of the described premises to the requirements of the City's Zoning Yap and Code. Section S: Inasmuch as it is necessary for the peace, health and safety of the r ":'. Proceedings on Proposal No. 1324 coimnenoed upon receipt by the Bpmdary Canni.ssion of a petition from property owners on September 7, 1978 requesting u.i.ia t certain pro—per-by be ai[coxed to the city. The petit,on trets, the requirenents for initiatip.g a proposal set forth in ORS 222.170 and paragraph (a) Section (4) of ORS 199.490. Upon receipt of the petition, the Boundary Caannission published and posted notice of the public hearing in accordance with ORS 199.463 and conducted a public hearing on the proposal on October 18, 1978. The Coffmission also caused a study to be made on this proposal which considered economic, demographic and sociological trends and projections and physical development of the land. FINDING Cr, rhe basis of the public hearing and the study, the Boundary Commission found that: 1. The territory to be annexed is contiguous to the city and contains c�n estimated population of 21, and is evaluated at $283,000. 2. The property owners desire annexation to obtain sewer service frim the city. 3. the proposal is in confonnance with LCDC Goals # 1, 2, 3, 11, 12 and 14. Goals 4-10, 13 and 15-19 were examined and found not to apply here. 4. This proposal is oonpatible with regional, county and city planning. 5 Sewer service is available from a new sewer line serving Edwards' subdivision to the.west running in an easement through the territory to be annexed and dawn 114th .s't. 6. The territory is currently served by the Tigard Water District and the Tualatin M`PD. rniese services will not be,affected by the annexation. 7. An unicorporatecd island is created by the proposal. Those parties along 112th Street have signed non-remonstrance agreements with the city for_ annexation. rTMC NS FOR DECISION Cn the basis of the findings the'Commission detenrdned that: ■ 1. The property owners desire sewer service from the city. The area is fully developed and no additional developwnt Is proposed. 2. T1'm territory is within an unincorporated peninsula jutting into the city's boundary. The area is a logical part of the city. 3. TJpon annexation, a full range of urban services adequate to serve the area is available. 4. The proposal is in confor3pance with LCDC Coals and with all applicable land use plans.
