Ordinance No. 78-87■ CITY OF TIGARD, OREGON ORDINANCE NO. 78- AN ORDINANCE ESTABLISHING A RESIDENCY REQUIREMENT FOR CITY DEPARTMENT HEADS. THE CITY OF TIGARD ORDAINS AS FOLLOWS: Section l: The City Council finds that at the November 7, 1978 general election the voters of the City approved by a majority vote : passage of an ordinance establishing a residency requirement for department heads. Section 2: The following addition to the Municipal Code is made, to be designated Chapter 2.06, DEPARTMENT HEADS, the body of the chapter to be as follows: Chapter 2.06 DEPARTMENT HEADS Sections: 2.06.010 Residency Required--Affected Positions 2.06.020 Persons Employed as of January 17, 1979 not Affected 2.06.030 Extension of Time to Comply 2.06.040 Sanction 2.05.050 "Immediate Urban Growth Boundary" Defined -� 2. 06.010 Residency Required---Affected Positions. All persons employed full-time by the City of Tigard in the positions named in this ordinance are hereby required to establish permanent residency within the city limits or within the area designated as Tigard's Immediate Urban Growth Boundary L-,rithin 120 days following appointment. The affected positions are the following: City Administrator, City Recorder, Chief of Police, Planning Director, Public Works Director, City Engineer, Head Librarian, and City Building Official. Any person hired or appointed to be the chief administrative officer of any other department of the City hereafter created shall also be required to comply with the terms of this ordinance. 2.06.020 Persons Employed as of January 17, 1979 not Affected. Persons employed in the affected positions on the date this ordinance takes effect (January 17, 1979) shall not be required by this ordinance to establish residency within the Urban Growth Boundary of the City of Tigard. ORDINANCE NO. 78-_R7_ r 2.06.030 Extension of Time to Comte. The City Council may at its discretion extend the period for compliance with this ordinance an additional 30 days. Such an extension may be given t.^, u�ay a4..L I-U employee if that employee has made a demonstrable effort to comply by arranging for the purchase of a home within the city limits before the end of the applicable period, and the delay preventing full compliance is caused only by the delay in completing any required real estate transaction, and that delay does not arise on account of any fault of the employee. 2.06.040 Sanction. Failure to establish residency within the required area within the time allowed by this ordinance shall result in immediate termination of employment by the City of Tigard. 2.06.050 "Immediate Urban Growth Boundary" Defined. For the purposes of this ordinance the:.term "Immediate Urban Growth Boundary" shall mean the Urban Growth Boundary approved and adopted with regard to the City of Tigard by the Oregon Land Conservation and Development Commission. If, however, at any relevant time t:e City Council of the City of Tigard has reviewed and approved an Urban Growth Boundary that is different from the boundary recognized by LCDC, for whatever purpose, the City Council may choose (but is not required) to make that boundary, rather than the LCDC-approved boundary, a test for compliance with this ordinance. �1 n.. ......'uncl. members -resent after/ PASSED: By ananikivus vote of aim wa members being read two times by number and title only, this Ism` day of t24- 1978.
