Ordinance No. 78-31 CITY OF TIGARD, OREGON ORDINANCE No. 78 AN ORDINANCE RATIFYING, CONFIRMING AND RECORDING CHANGE IN THE BOUNDARIES OF THE CITY OF TIGARD BY THE BOUNDARY COMMISSION, ORDER No. 1196 , INVOLVING LANDS OF WARDIN PROPERTIES, SECT. 1, T2S, RANGE 1 WEST, WILLAMETTE MERIDIAN, WASHINGTON COUNTY, OREGON, RECORDING EFFECTIVE DATE AND DECLARING AN EMERGENCY. WHEREAS, the Boundary Commission established pursuant to Chapter 494 Oregon Laws of 1969 for the Portland Metropolitan Area, by its final order dated March 15, 1978 approved the hereinafter described change in the boundaries of the City of Tigard, and a copy of said final order has been filed with the City Recorder. NOW, THEREFORE, THE CITY OF TIGARD ORDAINS AS FOLLOWS: Section 1: That the final order of the Boundary Commission adopted on the 15th day of March , a copy whereof is hereto attached and by this reference made a part hereof, be, and the same is, hereby ratified, confirmed and adopted by reference to the same legal force and effect as if set forth herein in full. Section 2: That the boundaries of the City of Tigard be, and they are hereby, changed to include the lands as described in the within order of the Boundary Commission, and the corporate limits of the- City of Tigard are hereby changed in conformity therewith. Section 3: That the Recorder of the City of Tigard be, and she is hereby, directed to forthwith file a copy of this ordinance, including a copy of said Order, in the following offices: (a) Secretary of State (b) .Department of Revenue and Taxation, Washington County (c) Department of Records and Elections, Washington County (d) Department of Public Works, Attention: Surveyor, Washington County - Section 4: That the City Planning Commission be, and it is hereby, authorized and directed to conduct such proceedings as may be necessary to conform the authorized zoning and land use of the described premises to the requirements of the City's Zoning Map and Code. Section 5: Inasmuch as it is necessary for the peace, health and safety of the people of the City of Tigard that the foregoing change in the boundaries of the City become a permanent part of the City's records, an emergency is hereby declared to exist, and this ordinance shall be effective upon its passage by the Council, and approval by the Mayor. W. Hall Street - Portland, Oregon 97201 - Tel; 229-5307 FINAL ORDER Re: BOUN11E1RY (MANGE PROPOSAL NO, 1196 - Annexation of territory to the { City of Tigard. Proceedings on Proposal No. 1196 commenced upon receipt by the'Boundary Commission of a petition from property owners 'on January 31, 1978 requesting that certain property be annexed to the city. The petition meets the require- ; ments for initiating a proposal set forth in ORS 222.170 and paragraph (a) Section (4) of ORS 199.490. i 3 Upon receipt of the petition the Boundary Commission published and posted g notice of the public hearing in accordance with ORS 199.463 and conducted z a public hearing on the proposal on March 15, 1978. The Commission also caused a study to be made on this proposal which considered economic, demographic and sociological trends and projections and physical development of the land. Sg f 'FINDINGS t On the basis of the public hearing and the study the Boundary Commission found that: I. The original territory to be annexed is contiguous to the city and contains 6.3 acres, 2 single-family residences and one commercial structure, an estimated population of 2 and is evaluated at $790,000. 2. There are no development plans. The petitioners desire to obtain city services. 3. The site slopes gently to the south and is within the "Tigard Triangle" bounded by Hwy. 99W, Hwy. 217 and I-5. 4. The Tigard Comprehensive Plan designates the area as Residential-Commercial. The Tigard Triangle Plan, a more detailed plan, designates the tecrituiT Office Park. I S. The Washington County Plan designates the territory Urban. Current county zoning is B-2, B4-2, and B4, commercial zones. 6. The CRAG Framework Element designates the area Urban. 7. The proposal is in conformance with LCDC goals. S. Sewer and water are extended to the commercial structure on the site (Allstate). The sewer serving the property is a 8-inch line located in S. W. 68th and Franklin. 9. The territory is within the Metzger Water District. The water line serving the territory is a 12-inch Tigard Water District main located in SW 67th. The Metzger District has constructed an 8-inch main to serve the area. The district plans to beggin serving the parcels currently served out-of-district by the Tigard Water District. 10. The territory is within the Tualatin RFPD and this service will not be altered by annexation. 11. The proposal as originally submitted did not include the westerly one- half of that portion of Interstate 5 immediately adjacent to the terri- tory to be annexed. Exclusion of that portion of T-5 would leave an illogical boundary since a portion of I-5 south of the area to be annexed is already in the city. REASONS FOR DECISION On the basis of the findings the Commission determined that: 1. Annexation to provide urban services is a prerequisite to developing the property. 2. The city, county, and regional plans are consistent with one another for this area. 3. The Allstate development is receiving services from the city and should logically be part of the city. 4. A full range of urban services will be available to the property immediately upon annexation. S. Inclusion of the westerly one-half of Interstate 5 right-of-way immediately adjacent to the territory will provide for a more orderly and logical city boundary. ORDER On the basis of the findings and reasons listed above, the Boundary Com- mission approved BOUNDARY CHANGE PROPOSAL NO. 1196 as modified on March 15, 1978. NOW THEREFORE IT IS CRDERED THAT the territory described in Appendix "A" and depicted on the attached map, be annexed to the City of Tigard as of this date.
