AN ORDINANCE AMENDING TITLE 14 BUILDING AND CONSTRUCTION, OF THE TIGARD MUNICIPAL
CODE BY ADDING TO CHAPTER 14.04, SECTION 14.04.064, OCCUPANCY PERMITS, A SUB-SECTION
306 (f) (1) DEALING WITH RECORDABLE'_OCCUPANCY RESTRICTIONS, FIXING AN EFFECTIVE
DATE AND DECLARING AN EMERGENCY.
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section 1: That Section 14.04.064 of the Tigard Municipal Code ,be amended by
adding sub-section 306 (f) (1) to be setforth as follows:
Section 306 (f)(1): At the time of issuance of a building permit
for new construction as designated in Section
14.04.063, sub-section 306 (a) above, the
Building Official may require the applicant to
execute, not6rize, and deliver to the City,
a recordable occupancy restriction in the form
prescribed. The applicant shall pay all applicable
fees. The Building Official shall cause said
restriction to be recorded in the deed records
of Washington County, Oregon.
When all conditions for occupancy have been
satisfied, the occupancy permit shall be issued
and the deed restriction released.'.
Section 2: Because thisprovision is necessary to protect the health, safety and
general welfare of the public, an emergency is declared to exist and
this ordinance shall become effective upon passage by the Council
and approval of the Mayor.
