Ordinance No. 78-13 13 CITY OF TIGARD, OREGON Ordinance No. 78-x_ AN ORDINANCE PRESCRIBING POLICIES AND PROCEDURES FOR THE EFFICIENT RESERVATION OF PUBLIC PARKS AND RECREATION FACILITIES FOR GROUP ACTIVITIES, AND IMPOSING APPROPRIATE FEES FOR GROUP USE OF SUCH FACILITIES AND SERVICES PROVIDED, FIXING AN EFFECTIVE DATE AND DECLAR- ING AN EMERGENCY. WHERE AS the City Council pursuant to Ordinance No. 71-12 declared the intent to exercise general supervision, management and control of all public parks and associated facilities and equipment, and to prescribe the necessary rules and regulations necessary to protect and preserve such facilities for the convenient and safe use by the public. Therefore, in order to implement the decision described above, the City of Tigard ordains as follows: Section 1: Purpose The purposes of these rules and regulations are: A. To facilitate maximum use of public facilities by the general public. B. To coordinate the use of park and recreation facilities, thus assuring maximum opportunity for use through the convenience of advance reservations. C. To provide facilities at minimal cost to the general public, but where exclusive use takes place or special handling is required, to assess the appropriate fee. D. To coordinate the public use of facilities with maintenance, construction and other activities. Section 2: Facility Reservation - Parks In order to provide for the convenience of advance reservation of park facilities, the following procedures are hereby adopted: ° Formal application must be made at City Hall to reserve any public park and recreation facility for the exclusive use of a specified area by a particular group. ° All applications must be made, at least two (2) weeks in advance of the date requested for facility use, and shall include the name of the organization/ group, the facility requested, date and time requested, name, address and phone number of person in charge, type of activity and any special requests. ° The person in charge must sign the application. Section 3 Establishment of Fees and Crediting of Funds The following fees sha11 be collected by the City Administrator or his delegate and placed in the appropriate fund: A. A $10 application fee shall be required for all park reservation requests, and shall be placed in thegeneralfund to defray the costs of administrative activities. a r Section 3 (Continued) B. A fee shall be collected for preservation of facilities in community and urban parks, as defined in the adopted park standards and placed in the general fund to be expended for park maintenance, according to the following schedule; 1. For reservation of picnic areas: (Sez Section 5 for definition of group classifications). Fees for s ecial equipment and/or personnel unknown at the time of application will be billed to the person in charge, after the activity € when computation is accomplished. 5. Use of Agency facilities for fund raising will be handled on an t' individual basis. Groups or individuals desiring to conduct fund raising activities should apply for a "Special Use Permit" on the application form, and will be required to present their fee structure for review. 4 Section 4: Refund of Fee Any group seeking a refund because of inability to use facilities as requested .shall submit a written statement of refund request, to include 1. Name of group, address and telephone. 2. Name, address and phone number of person/group to whom refund is to be paid. 3. The reason for seeking the refund and the amount requested. All refund requests must be approved by the City Administrator. Page 2 Ordinance No. 78 /� Section 5: Waiver of Fees No waiver shall be granted except by approval of the Park Board and the City Administrator and in accordance to the following standards: 1 No waivers shall be granted for the application fee. 2. Fee Group Classifications: t Grou I: No Fees - City sponsored groups and programs, School District 23J, local youth groups, low income groups and Tigard Little League and Soccer League (ball fields only). ! Group II: Fees as listed under Group II in Section 3B, herein all non-profit groups including churches, garden clubs, business an and social clubs, fraternal organizations and government agencies. I Groups III: Fees as listed under Group III in Section 3B, herein all profit making groups including company or corporate sponsored activities. 3. Fees for facility reservation (Group II & III) may be waived (in whole or part) on a descretionary basis for groups submitting a written request to the City Administrator. Approvals or reasons for a denial will be forwarded to the applicant. Section 6: This ordinance being necessary for the efficient operation, protection and maintenance of City parks and in order to protect the health, oµraty and welfare of the people of the City of Tigard,,an emergency is hereby declared to exist and this ordinance shall be effective upon its' passage by the Council, and approval by the Mayor, PASSED By tirJrc� .r�nu y vote of all Council Members present this i date of 1978, after being read two times by number and title only.
