AN ORDINANCE AMENDING THE NPO #5 ENACTING ORDINANCE #77-69 WITH RESPECT
TO THE AREA DESIGNATED "STUDY AREA" ADJACENT THE DURHAM WASTEWATER
TREATMENT PLANT AND THE SPINE ROAD PROPOSED TO CONNECT BONITA ROAD AND
HALL BOULEVARD.
THE CITY OF TIGARD ORDAINS AS FOLLOWS :
SECTION 1: The City Council finds that it is necessary, expedient and
in the best interest of the people of the City of Tigard
that the Plan Map of Neighborhood Planning Organization No. 5 be
revised so as to attain the purposes of ORS Chapter 197 and ORS
Chapter 227 insofar as applicable.
SECTION 2: The Council further finds that pursuant to prescribed
procedures, application for amendment of the adopted
Neighborhood Planning Organization No. 5 was the subject of a public
hearing at Fowler Junior High School, Tigard,Oregon on September 19,
1977 by the City Council at which time an oral presentation of the
amendments to the plan was given, and all interested persons were
afforded an opportunity to be heard with respect thereto and to
comment thereon.
SECTION 3: Based on the evidence presented by the Planning Depart-
ment the Council makes the following findings:
a) That realignment of the spine road as shown in Exhibit
"A" is deemed necessary due to the lotting and development
pattern at S.W. 79th Street and S.W. Bonita Road which
will preclude development of the proposed "spine road"
in conjunction with the development of the vacant parcels
of land along its proposed route.
b) That adopting a special institutional land use category for
that area adjacent the Durham Wastewater Treatment Plant
(Exhibit "B") is in the best interest of the community_in-
sofar as the proposed land uses specified in Section 5
of this ordinance are compatible with the operation of the
treatment plant as well as the abutting high school and
residential development
SECTION 4: In furtherance of the above findings, the proposed amend-
ments are hereby approved as embodied in or exhibited
by the document submitted and identified as follows:
Exhibit "A" : Spine Road alignment Plan
Exhibit "B": Institutional Land Use Plan
and to include the following land use categories as appropriate to
the area designated "Institutional. "

PERMITTED USES
Customary Agricultural Operations including general farm-
ing, truck farming, fruit orchards, nursery, greenhouses
and usual farm buildings.
Office Buildings for executive or administrative uses
and industrial product sales and service, and pro-
fessional offices or similar uses.
Research and Development Laboratories including ex-
perimental, testing and processing facilities.
Manufacturing and Assembles of Electronic Instruments and
Equipment and Electrical Devices.
Trade, Skills or Industrial Schools.
Publishing, Printing, and Bookbinding Facilities.
Manufacturing of Medicines and Pharmaceuticals.
Manufacturing and Assembly of Precision Instruments,
Tools or Devices.
CONDITIONAL USES
Indoor and Outdoor Recreation Facilities including
tennis, racquet and handball courts, and swimming fac-
ilities.
Institutional Uses including schools, public utilities,
such as waste water treatment facilities, lodges for
fraternal organizations, and churches.
2. Institutional land use be subject to the specific requirements
of the-M-4 zone where applicable.
_ SECTION 5: This Ordinance shall be effective on and after the 31st
day after its passage by the City Council and approval
by the Mayor.
PASSED: vote of all Council Members present this
date of 1977, after being read three times by number
and title only.
