Ordinance No. 77-31 ( CITY OF TIGARD, OREGON ORDINANCE No. 77-_h l j4 { AN ORDINANCE AMENDING THE TIGARD MUNICIPAL CODE CHAPTERq.8.` 1�_ TO ESTABLISH 400 FEET AS THE MAXIMUM LENGTH OF A CUL-DE-SAC AND DECLARING AN EMERGENCY. � THE CITY OF TIGARD ORDAINS AS FOLLOWS: Section 1: Finding that pursuant to Chapter 227 ORS and Ordinance No. 68-48 (City of Tigard Subdivision Ordinance of 1968) the hereinafter stated amendment to said ordinance, pursuant to prescribed procedures, were submitted to public hearing held by the Tigard Planning Commission on March 1, 1977, and to the City Council thereafter recommended that said subdivision ordinance be amended as hereinafter set forth. Section 2: The City Council further finds that after due and legal notice, a public hearing was held by the City Council April 25, 1977, where all interested persons were afforded an opportunity to be heard and present and rebut evidence with respect to said amendment. i F f Section 3: The City Council further finds that the purpose for this amend- ment is to protect the public health, safety and general welfare and, furthermore said amendment serves to implement the city's objectives and policies concerning the development of a safe and efficient street g. system. Section 4: That therefore Chapter 17.28.110 be amended to read as follows: " A cul-de-sac shall be as short as possible and shall in no event be more that four hundred feet long. All cul-de-sacs shall terminate with a circular turn-around having a minimum right- of-way radius of fifty feet. The length of the cul-de-sac shall be measured along the centerline of the roadway from the near side of the intersecting street to the farthest point of the cul-de-sac." Section 5: Inasmuch as it is necessary for the peace, health and safety �. of the people of the City of Tigard that the foregoing change 4 ' become a permanent part of the city's records, an emergency is hereby de- clared to exist, and this ordinance shall be effective upon its passage by Council, and approval by the Mayor.
