Ordinance No. 77-11 CITY OF TIGARD, OREGON j ORDINANCE NO. 77-- 11 I AN ORDINANCE DETERMINING THE FINAL COST OF STREET IMPROVEMENTS IN THE S. W. HUNZIKER STREET LOCAL IMPROVEMENT DISTRICT, RATIFYING AND ADOPTING THE APPORTIONMENT AND ASSESSMENT OF THE COST TO RESPECTIVE PARCELS OF LAND WITHIN THE DISTRICT; SPREADING THE ASSESSMENT; DIRECTING THE ENTRY OF ASSESSMENTS IN THE LIEN 1 DOCKET; DECLARING AN EMERGENCY. I THE CITY OF TIGARD ORDAINS AS FOLLOWS : Section 1: The Council finds that by Ordinance No. 75-1 adopted on January 13, 1975, the Council authorized and directed that the construction of street improvements within the boundaries E of the S. W. Hunziker Street Improvement District, as bounded and described in said ordinance, be undertaken by contract, and that said work has now been completed. i Section 2: The Council finds that the total final assessable cost of the improvements within the boundaries of the Improvement District is the sum of $213,200 and the Council further finds that all lots, parcels or parts of lots within the boundary of the District as defined by Ordinance No. 75-1 are specially benefited and together shall bear equitable shares of the cost of said improvement Section 3: The Council further finds that the apportionment of the cost of the improvement upon each lot, part of lot or parcel, as prepared by the City, and as set forth in the attached schedule, entitled "S. W. Hunziker Street Improvement District," which, by reference, is made a part of this Ordinance, is according to the special and peculiar benefits accruing thereto from the improvement. Section 4: The Council further finds that the City Recorder of the City of Tigard h as mailed or caused to be personally delivered to the owner of each lot or tract proposed to be assessed, a notice of assessment, which notice stated the amount of the assessment proposed on that property and also stated a date by which time objections should be filed with the City Recorder. Section 5: The City Council finds that at its regular meeting of January 10, 1977, the City's final estimates of assess- ments and all objections filed with the City Recorder were duly considered, and the City Council at that time determined the assessments to be properly apportioned according to the special 1 - Ordinance No. 77- 11 and peculiar benefits accruing to each parcel, part of lot or lot within the Improvement District. Each lot, parcel or part of lot as designated in the attached apportionment schedule is hereby assessed and charged with the total sum shown on the line opposite, and the assessment shall constitute a lien against each of the said properties from and after the passage of this Ordinance and entry in the City Lien Record as hereafter provided. i Section 6: The City Recorder is hereby directed to enter each and a all of said lots, parts of lots or parcels and the amount of assessment against each, as shown by the attached schedule, in the Lien Docket of the City separate from other prior or subsequent assessments, and the same shall constitute a lien against each respective lot, part of lot or parcel, and bear interest at 7% per annum until paid. Section 7: Inasmuch as it is necessary for the preservation of the public peace, health and safety of the people of the City of Tigard that this ordinance take effect immediately ' in order that final provision may be made for payment of the cost of construction of said street improvements and the final deter- mination of the assessments therefor, an emergency is hereby declared to exist and this ordinance shall be effective upon its passage by the Council and signature by the Mayor. _PASSED: By unanimous vote of all Council members present, after being read three times by number and title only this 24th day of January, 1977.
