Hall Street - Portland, Oregon 97201 - Tel: 229-5307 FINAL ORDER RE: BOUNDARY CHANGE PROPOSAL NO. 995 - Annexation of territory to the City of Tigard. Proceedings on Proposal No. 995 commenced upon receipt by the Boundary Commission of a petition from property owners on October 7, 1976 requesting that certain property be annexed to the city. The petition meets the requirements for initiating aproposal set forth in ORS 222. 170 and paragraph (a) Section (4) of ORS 199.490. Upon receipt of the petition, the Boundary Commission published and posted notice of the public hearing in accordance with ORS 199.463 and conducted a public hearing on the proposal on November 17, 1976. The Commission also caused a study to be made on this proposal which considered economic, demographic and sociological trends and projections and physical development of the land. FINDINGS On the basis of the public hearing and the study the Boundary Commission found that: 1. The territory to be annexed is contiguous to the city and contains 12.3 acres, is vacant and is evaluated at $5, 100. 2. The property owners desire city services to facilitate development. Development will be single family residential at a density of four units per acre. 3• proposed The p osed CRAG Framework Pian and the Washington County p Framework Plan identify this area as Urbana The city plan classifies the area as suitable for urban low density residential which specifies a maximum density of 4 units per acre. 4. The city has an 8-inch sewer line adjacent to the northwest corner of the territory. Other city services such as planning and subdivision control, street maintenance, library, etc. , will be available upon annexation. 5. The Tigard Water District has a 6-inch line in Ironwood Loop adjacent to the northwest edge of the territory and the territory and the city are within the district. Page 1 FINAL ORDER 6. Fire protection is provided to both the territory to be annexed and adjacent parts of the city by the Tualatin RFPD. REASONS FOR DECISION On the basis of the findings the Commission determined that: 1. The property owner desires city services which they need in order to develop the property. 2. The proposed development complies with city planning designation of the area as suitable for low density residential development. 3. The city has sewer service available adjacent to the area to be annexed. Fire and water service are available from the Washington County RFPD and the Tigard Water District respectively and these entities also serve the adjacent parts of the city. ORDER On the basis of the findings and reasons listed above, the Boundary Commission approved BOUNDARY CHANGE PROPOSAL NO. 995 on November 17, 1976. NOW THEREFORE IT IS ORDERED THAT the territory described in Appendix "A" and depicted on the attached map, be annexed to the City of Tigard as of this date.
