ORDINANCE No. 76-
AN ORDINANCE AMENDING ORDINANCE No. 66-1, AS AMENDED BY ORDINANCE No. 71-21,
AS AMENDED BY ORDINANCE No. 74-41, (GARBAGE FRANCHISE GRANTED TO FRANK S
DISPOSAL SERVICE, INC.) PRESCRIBING REVISED RATES FOR COLLECTION AND »;
DISPOSAL SERVICES, DECLARING AN EMERGENCY AND FIXING AN EFFECTIVE DATE.
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section 1: That section 20 of Ordinance No. 74-41 be and the same is
hereby amended to read as follows:
"Section 20: The rate to be charged to all persons, ffirms
and corporations by the collector shall be
reasonable and uniform taking into consideration the services
rendered by the collector and the rates authorized and charged
for similar and equal services rendered in unincorporated
areas and other municipalities within Washington, Multnomah
and Clackamas counties, and shall not exceed those authorized
in the attached Schedule "B" and by this reference made a
part hereof; and further provided that the collector shall '
grant no preference in rates to any person, organization or
owner for any reason, but all,charges shall be uniform for the
same or similar services.
The City reserves the right to amend the rate
herein prescribed or to prescribe additional classifications
and charges which shall be applicable to the services to be
rendered hereunder,"
Section 2: Whereas Frank's Disposal Service, Inc. has provided detailed
financial data to the City Council, which data indicates that
the financial soundness of said company is in part contingent upon the
imposition of a revised rate schedule as soon as possible and whereas it
is in the best interest of the public health, safety and welfare to
retain and continue a franchise agreement with a fiscally sound
franchisee, an emergency is hereby declared to exist and this ordinance,
revising rates, shall become effective upon the 1st day of January, 1977.
PASSED: By the Council, by unanimous vote of all Council members
present, after being ,read three times by title and number
this 13 day of December , 1976.
