ORDINANCE No. 76- 41
AN ORDINANCE AMENDING TITLE 7.40.070, NOISE, OF THE TIGARD MUNICIPAL CODE,
BY REDEFINING THE POINT AT WHICH NOISE MEASUREMENTS ARE TO BE TAKEN, AND
PRESCRIBING AN EFFECTIVE DATE.
THE CITY OF TIGARD ORDAINS AS FOLLOWS:

Section 1: Subsection (a) and (b) of Section 7.40.070 of the Tigard
Municipal Code is hereby amended to read as follows:
7.40.070 Noise. (a) No person shall operate a motor
vehicle in such a manner or at such a location as to cause
the noise created by the vehicle to cause the ambient
noise level at the nearest noise-sensitive property to
exceed the 3levels, specified in subsection (c) of this
section, as measured ,at a point located 25 feet from
the noise-sensitive structure toward the noise source.
(b) No person shall cause 'or permit noise to emanate
from property under his or her control so as to cause
the ambient noise level at the nearest noise-sensitive
property to exceed the levels set forth in subsection (c)
of this section, as measured at a point located 25 feet from
the noise-sensitive structure toward the noise source.
Section 2: This ordinance shall take effect on the 31st day following
final passage and approval by the City Council.
