Ordinance No. 76-44 CITY OF TIGARD, OREGON ORDINANCE NO. 76-_At�_ AN ORDINANCE AMENDING THE TIGARD MUNICIPAL CODE CHAPTER 18.58, SITE DEVELOPMENT PLAN TO CLARIFY BEGINNING POINT FOR MEASUREMENT OF FRONT YARD LANDSCAPING IN M-2, 3 AND 4 ZONES; AND CHAPTER 18.60, OFF-STREET PARKING AND LOADING TO RECTIFY DISCREPANCIES AND CLARIFY ANY VAGUENESS WITH RESPECT TO ALLOWANCE OF OFF-STREET PARKING IN YARD SETBACKS. THE CITY OF TIGARD ORDAINS AS FOLLOWS: Section 1: Finding that pursuant to Chapter 227 Oregon Revised Statutes and Ordinance No. 70-32 (City of Tigard of 1970) the hereinafter stated amendments to said Ordinance, pur- suant to prescribed procedures, were submitted to public hearing held by Lhe Tigard Planning Commission on September 21 , 1976, and to the City Council thereafter recommended that said zoning ordinances be amended as hereinafter set forth. Section 2: The City Council further finds that, after due and legal notice, a public hearing was held by the City Council October 25, 1976, whereat all interested persons were afforded an opportunity to be heard and present and rebut evidence with r,Gas­)ct to said amendments. Section 3: The City Council further finds that the purpose for 'r these amendments are to protect the public health, safcty acid general welfare and, furthermore, said amendments are in thu public interest to clarify conflicts or vagueness among sections in the Tigard Municipal Code. Section 4: That therefore, 18.58.080 Landscaping and Screening M-2, M-3 and M-4 zones all areas not occupied by paved roadways, structures, or walkways shall be landscaped A-minimum of twenty feet shall be landscaped shall be amended to read: 18.58.080 (2) Landscaping and Screening - M-2, M-3 and M-4 Zones. All areas not occupied by paved roadways, _structures', or walkways shall be landscaped. A minimum of twenty feet from the existing street right-of-way__or the future right-of-war line as designated in Section 18.12.100 shall be landscaped. .. and that therefore, 1.8.60.100 Landscaping, screening requirements.
