Ordinance No. 76-42 CITY OF TIGARD, OREGON ORDINANCE NO. 76- 42— AN ZAN ORDINANCE PERMITTING THE OPERATION OF GOLF CARTS ON STREETS IN SUMMERFIELD. THE CITY OF TIGARD ORDAINS AS FOLLOWS: Section 1: The Tigard City Council acknowledges that the use of golf carts on certain streets within Summerfield would be beneficial to the residents of Summerfield and would create no signifcant hazard to either the users of the golf carts or other traffic on the streets within Summerfield. Section 2: Chapter 271, Section 4, of Oregon Laws 1975 authorizes the City Council of the City of Tigard to permit the operation of golf carts on public streets within the City of Tigard and to prescribe such rules and regulations for the operation of golf carts as may be necessary. Chapter 271, Oregon Laws of 1975, further defines golf carts, exempts them from registration ane! license as a motor vehicle, and sets forth certain limitations regarding the areas in which they can be used. Section 3: Summerfield is a planned residential area qualifying as a real estate development under the terms of Chanter 271, Oregon Laws of 1975. Section 4: Golf carts may be driven upon the streets in Summerfield during daylight hours for the purpose of moving the carts betweentheresidences of their owners and operators and the recrea- tional areas within Summerfield. Golf carts shall at all times be operated in a prudent manner, and shall be subject to the statutory laws of the state of Oregon and the Ordinances of the City of Tigard with regard to the operation of vehicles, except such statutes and ordinances as cannot be complied with on account of differences in equipment required on golf carts as compared with ordinary passenger vehicles and trucks. Section 5: Operation of golf carts shall be undertaken at the risk and responsibility of the owners and operators, and the z City of Tigard by this ordinance assumes no responsibility for the 1 Ordinance No. 76- _ operation of the vehicles, and shall be held harmless in any action arising from the operation of golf carts on or off of any public way in Summerfield. This would be in accordance with O. R.S. , Section 1 the°ough 4, Chapter 271. This past evening, September 14, 1976, the Board of Directors of the �> Summerfield Civic Association passed a resolution requesting your consideration of such an ordinance to cover golf carts going to and from the resident's homes to the golf course and crossing city streets in the course of golf play. The .Council of the City of Kir.{ City recognizes that the use of self nrooel'.ed golf carts is a necessary factor in the recreational needs of many of the residents of Sing City. That physical ran3icap5 and the age factor make such conveyances not only desireable but in many cases mandatory in the healthful recreation of our residents. The Council further finds that the storage of this equipment is not possible exce5t at the home of the resident and that some use of City streets and public ways is necessary to travel to and from the recreational area. Chapter 271 SECTION 2. ORS IPS '"'-a-grants authority to local governments to permit the use of golf carts on any streets or public ways under their jurisdiction, and to prescribe such rules and regulations for operation of such conveyances as may be necessary for such operation. The City Council therefor ordains t:.at such conveyances be permitted the use of all of the streets in King City, during daylight hours, for the pu:,pose of transporting the conveyance to and from the recreational areas. No ti such permission is intended or implied for an,; public way other than those within the boundaries of King City. Such conveyances shall at all times be operated in a prudent .earner, obeying the basic rules of traffic and keeping well to the right in the regular traffic pattern as a slow moving vehicle. The conveyance may also display the emblem de-noting a slow moving vehicle . Operation of these conveyances shall be totally the risk and responsibility of the oiler'tor. The City of Kine City by this ordinance of permission and designation, shall assume no responsibility for the operation of the vehicle, and shall be held harmless in any action arising from the operation of such conveyances on or off any public way ir.
