Ordinance No. 76-40 i/ CITY OF TIGARD, OREGON ORDINANCE No. 76 - 40 AN ORDINANCE RATIFYING, CONFIRMING AND RECORDING CHANGE �1 IN THE BOUNDARIES OF THE CITY OF TIGARD BY THE BOUNDARY COMMISSION, ORDER NO. 955 , INVOLVING LANDS OF Stark, Olson, 122nd/Scholls Ferry t Road area, Township 1 South, Range 1 West, Willamette Meridian, WASHINGTON COUNTY, OREGON, RECORDING EFFECTIVE DATE, AND DECLARING AN EMERGENCY WHEREAS, the Boundary Commission established pursuant to Chapter 494 Oregon Laws of 1969 for the Portland Metropolitan Area, by its final order dated Amt 25, 1976 approved the hereinafter described change in the boundaries of the City of Tigard, and a copy of said final order has been filed with the City Recorder, i NOW THEREFORE, THE CITY OF TIGARD ORDAINS AS FOLLOWS: Section 1: That the final order of the Boundary Commission adopted on the 25th day of August 1976 _ a copy whereof is hereto attached and by this reference made a part hereof, be, and the same is, hereby ratified, confirmed and adopted by reference to the same legal force and effect as if set forth herein in full. Section 2: That the boundaries of the City of Tigard be, and they are hereby, changed to include the lands as described in the within order of the Boundary Commission, and the corporate limits of the City of Tigard are hereby changed in conformity therewith. Section 3: That the Recorder of the City of Tigard be, and she i is hereby, directed to forthwith file a copy of this ordinance, including a copy of said Order, in the following offices: (a) Secretary of State (b) Department of Revenue and Taxation, Washington County (c) Department of Records a,id Elections, Washington County (d) Department of Public Works, Attention: Surveyor, Washington County Section 4: That the City Planning Commission be, and it is hereby, authorized and directed to conduct such proceedings as may be necessary to conform the authorized zoning and land use of the 9escribed premises to the requirements of the City's Zoning Map and Code. Section 5: Inasmuch as it is necessary for the peace, health and safety of the people of the City of Tigard that the foregoing change in the boundaries of the Cic-y become a permanent ` part of the City's records, an emergency is hereby declared to by exist, and this ordinance shall be effective upon its passage the Council, and approval by the Mayor. Hall Street - Portland, Oregon 97201 - Tel: 229-5307 i FINAL ORDER t RE: BOUNDARY CHANCE PROPOSAL NO. 955 - Annexation of territory to the City of Tigard. r Proceedings on Proposal No. 955 commenced upon receipt by the Boundary Commission of a petition from property owners on June 22, 1976 requesting that certain property be annexed to the city. 4 The petition meets the requirements for initiatin a proposal set forth in ORS 222.170 and paragraph (a) Section (3� of ORS 199.490. i Upon receipt of the petition, the Boundary Commission published and posted notice of the public hearing in accordance with ORS 199.463 and conducted a public hearing on the proposal on July 28, 1976. The Commission also caused a study to be made on this proposal which considered economic, demographic and sociological trends and pro- jections and physical development of the land. i� FINDINGS ! K On the basis of the public hearing and the study the Boundary Commission found that: 1. The territory to be annexed is contiguous to the city and contains 168. 25 acres, 17 single family residences, one church, an estimated population of 51, and an assessed evaluation of $566,800. 2. The petitioners wish to annex to obtain city services in order I to facilitate development and the City of Tigard is the logical entity to provide an urban level of services. 3. CRAG's Draft III designates this property as Urban, and Washington County's Framework Plan designates the property as Urban Inter- mediate. The territory to be annexed is within the City of Tigard's sphere of influence and their Community Plan identifies this area as Urban Low Density (4 dwelling units per acre). 4. The City of Tigard has expressed support for the proposal because annexation is essential for effective land use planning. 5. The Washington County planning department has not condoned annexation . and feels annexation is premature and could have an impact on adjacent areas for which detailed planning is in a state of flux. Page 1 - FINAL ORDER 6. Water service is available from the Tigard Water District upon annexation to said district. 7. The proposal as submitted will create an "island" of unincorporated territory containing a subdivision containing approximately 35 houses. The majority .of residents of the subdivision expressed neither opposition nor support for inclusion of the subdivision in the proposed annexation. REASONS FOR DECISION On the basis of the findings the Ccmmnission determined that: 1. The petitioners desire to obtain a full range of urban services in order to facilitate development and annexation to the City of Tigard is the logical first step for a planned and orderly develop- ment of the properties, and provision of the public facilities and services urban densities require. 2. The city, county and regional comprehensive plans designate the territory to be annexed as urbanizable land. ORDER On the basis of the findings and reasons listed above, the Boundary Commission approved BOUNDARY CHANGE PROPOSAL NO. 955 on August 25, 1976. NOW THEREFORE IT IS ORDERED THAT the territory described in Appendix "At° and depicted on the attached map, be annexed to the City of Tigard as of this date.
