ORDINANCE No. 76-
AN ORDINANCE AMENDING SECTION 7.40.070 TIGARD MUNICIPAL CODE, RELATING TO NOISE
BY LIMITING THE HOURS DURING WHICH CONSTRUCTION MAY BE UNDERTAKEN.
Section 1: Section 7.40.070 (d) (3), Tigard Municipal Code, is hereby amended
to read as follows:
(3) Sounds originating on construction sites and reasonably
necessary to the accomplishment of work in progress; provided
however that no construction work may be carried on between
the hours of 9:00 am and 7:00 am except for bonafide emergencies
where the public health or safety is threatened or when a special
permit granted by the City Council, as been first obtained.
Any such special permit may be granted by City Council only
after first having held a hearing thereon and having otherwise
followed the procedures contained in Section 18.84 of this code.
Section 2: This ordinance shall become effective upon the 31st day following
its passage by the Council and approval by the Mayor.
