Ordinance No. 76-25 CITY OF TIGARD, OREGON ORDINANCE No. 76 - AN ORDINANCE AMENDING THE TIGARD MUNICIPAL CODE, CHAPTER 18.12, GENERAL PROVISIONS, SECTION 18.12.100 - YARD REQUIREMENT EXCEPTIONS, WITH RESPECT TO THE CENTERLINE SETBACK REQUIREMENT FOR S.W. WALNUT ST. WITHIN THE CITY OF TIGARD, PRESCRIBING AN EFFECTIVE DATE AND DECLARING AN EMERGENCY. THE CITY OF TIGARD ORDAINS AS FOLLOWS: Section 1: The City Council finds that pursuant to Chapter 197 ORS and Ordinance No. 70-32 - "City of Tigard Zoning Ordinance of 1970" - the hereinafter stated amendment to said zoning ordinance, after due and legal notice, was submitted to public hearing by the City Planning Commission on April 20, 1976, and to the Council there- after recommended that said zoning ordinance be amended as hereinafter set forth. Section 2: The Council further finds that, after due and legal notice, a public hearing was held by the City Council on May 10 , 1976, whereat all interested persons were afforded an opportunity to be heard with respect thereto, and conditions precedent fulfilled with respect to the following amendment to the City's zoning ordinance. Section 3: The City Council further finds that the City of Tigard's additional setback requirements for SW Walnut St. presently conflicts with those being applied by Washington County outside the City's incorporated limits and, in order that a uniform standard may be utilized by both jurisdictions, the City of Tigard's existing additional centerline setback of 40 feet for all of SW Walnut St. within the City be changed to reflect Washington County's requirement of 35 feet. Section 4: The Council further finds that the purpose for this amend- ment is to protect the public health, safety and general welfare, especially as relates to traffic hazards, and congestion; and furthermore, said amendment serves to implement the City's ob- jectives and policies concerning traffic circulation as stated in the Tigard Community Plan, Neighborhood Plan Number Two and Neighbor- hood Plan Number Three. Section 5: That Chapter 18.12, General Provisions, be amended to read as follows: 18.12.100, (d) Additional Setbacks DESIGNATED COLLECTORSTREETS ADDITIONAL CENTERLINE SETBACK REQUIRED All of SW Walnut St. within the City 35` ft. Section 6: Inasmuch as it is necessary for the peace, health and safety of the people of the City of Tigard that the zoning matters as hereinabove set forth be established with the least possible delay thereby to maintain currently the legislative integrity of the City's zoning ordinances, an emergency is hereby declared to exist and this ordinance shall be effective upon its enactment by the Council and approval by the Mayor.
