AN ORDINANCE AMENDING THE TIGARD MUNICIPAL CODE, CHAPTER 7.28, ADDING SECTION
7.28.130 RELATING TO HINDERING PROSECUTION, PROVIDING PENALTIES, AND PRESCRIBING
AN EFFECTIVE DATE.
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section 1: The City Council finds that the Ordinances of the City of Tigard do
not provide sufficient protection for the residents of the City from
persons committing the crime of hindering prosecution.
Section 2: The City Council further finds that the purpose of the amendment to
the Tigard Municipal Code hereafter set forth is to protect the
public health, safety and general welfare, especially as relates to prosecution,
conviction or punishment of a person who has committed a crime.
Section 3: Chapter 7.28, Obstructing Law Enforcement, is hereby amended by
addition of Section 7.28.130, as follows:
"7.28.130 Hindering Prosecution. (a) A person commits the
crime of hindering prosecution if, with intent to hinder the
apprehension, prosecution, conviction or punishment of a
person who has committed a crime or violation or with the
intent to assist a person who has committed a crime or
violation in profiting or benefiting from the commission of the
crime, he: (1) harbors or conceals such person; or (2) warns
such person of impending discovery or apprehension; or (3)
provides or aids in providing such person with money, transportation,
weapon, disguise, or other means of avoiding discovery or j
apprehension; ox (4) prevents or obstructs, by mans of force,
intimidation or deception, anyone from performing an act
which might aid in the discovery or apprehension of such,

person; or (5) .suppresses by any act of concealment,
alteration or destruction physical evidence which might aid
in the discovery or apprehension of such person; or (6) aids
such person in securing or protecting the proceeds of the crime.
(b) Hindering Prosecution is a Class A Misdemeanor."
Section 4: Thisordinanceshall become effective on and after the 31st day
after its passage by the Council and approval by the Mayor.
