W. 9'2n.d AND SOUTH OF DURHAM ROAD, COMMONLY KNOWN AS THE TIGARD HIGH SCHOOL SITE, FROM WASHINGTON COUNTY ZONING AND USE CLASSIFICATIONS TO COMPARABLE ZONING AND USE CLASSIFICATIONS OF THE CITY OF TIGARD, THEREBY BRINGING SAID AREA RECENTLY ANNEXED TO THE CITY OF TIGARD INTO CONFORMITY 0"ITH AND SUBJECT TO THE ZONING ORDINANCES AND REGULATIONS OF THE CITY OF TIGARD, AND TERMINATING THE APPLICABILITY THERETO OF WASHINGTON COUNTY ZONING ORDINANCES OR REGULATIONS; AND SETTINT AN "EFFECTIVE DATE. K THE CITY OF TIGARD ORDAINS AS FOLLOWS : Section 1: The City Council finds that certain area heretofore desig- nated as "the Tigard High School site" , more particularly described on the attached "Exhibit All, and by this reference made a part hereof, was annexed to the City of Tigard by recent order of the Metropolitan Boundary Commission and confirmed by City Ordinance, and k. that said lands were,heretofore subject to zoning and land use juris- diction of Washington County, Oregon, pursuant to Section 227.31.0 ORS. Section 2: That the City Council further finds that after due and legal notice, as by City Ordinance required, a hearing was duly and regularly held by the City Planning Commission on November 4, ' 1975, whereat all interested persons were afforded an opportunity to be heard with respect to the conversion and transition of the said � lands described in "Exhibit A" from County zoning and land use juris- diction and reclassifications to comparable and equal zoning and land use classifications as provided by the ordinances of the City of Tigard, and thereafter the Planning Commission, pursuant to Section 18.56.040 of the Tigard Municipal Code, submitted findings and recommendations as hereto attached, marked "Exhibit B" , and by this reference made a part hereof. Section 3 : The Council further finds that, after due and legal notice, h a hearing was duly and regularly held by the Council at its regular meeting of November 24 , 1975, whereat all interested persons and the general public were afforded a further opportunity to be heard with respect to the proposal to transfer zoning and land use jurisdiction from Washington County to the City of Tigard and to redesignate the classifications and uses of said lands from Washington County designation to comparable classifications and uses of the City of Tigard. The Com- mission's findings , as filed with the Council, are hereby adopted as the findings of the Council. i Section 4 : In accordance with the foregoing and in conformity wit'ri the Zoning Ordinances and Regulations of the City of Tigard, ` each of the tracts and ownerships of lands described in the attached "Exhibit All and the zoning use classification of each thereof be and the � t . •v same is hereby changed and reclassified from the Washington County use classification hereinafter set forth as applicable to each tract and ownership to the equal or comparable City of Tigard zoning and use classification hereinafter appearing and each and all of said tracts are hereby subject to the requirements of Title 18 of the Tigard Municipal Code applicable to each of said land and use classifications. Durham, S.W. 92nd and raUentl zone's Wash�i nnf-on County RS-1 to Tigard R-30, S.W. ,' Single Family Residential (Wash. Co. Tax map 2Sl 14A, Tax Lots 1001 101, 200, 1102, 1201) . STAFF FINDINGS 1. This is a legislative zoning of an annexed area of 49.49 acres in- a single parcel belonging to School District 23-J. 2. Subject parcel is the present site of Tigard High School located in the vicinity of S.W. Hall Boulevard and Durham Road. 3. Present County zoning in this area is RS-1 (SR) Which allows development on 20,000 to 40,000 square foot sized sites, depending on the utilities available. Schools, parks and recreational facilities are permitted by- right in this zone. 4. The City' s closest zone district classification is R-30, which permits schools and other governmental or public uses, but under conditional use permission. In the case of any previously permitted use which by reason of subsequent zoning action would become a conditional use, Tigard Ordinance t 75-42 provides that the particular use will, on that site, be considered a permitted use (subject to any particular condi-tions of development that may have been placed previously thereon) . 5. The present use of the subject site is in conformance with the Tigard Community Plan. 6. The proposed zoning conforms with the residential land use and density recommended by the Tigard Community Plan. STAFF RECOMMENDATION Approval. qU old
