Ordinance No. 75-50 CITY OF TIGARD, OREGON ORDINANCE No. 75- a AN ORDINANCE RATIFYING, CONFIRMING AND RECORDING CHANGE IN THE BOUNDARIES OF THE CITY OF TIGARD BY THE BOUNDARY COMMISSION, ORDER No. 846 , INVOLVING PARCELS BOUNDED BY S. W. 69th, HAMPTON STREET, SALEM FREEWAY AND S. W. GONZAGA STREET, SECTION 1, TOWNSHIP 2 SOUTH, RANGE I WEST, WILLAMETTE MERIDIAN, WASHINGTON COUNTY, OREGON, RECORDING EFFECTIVE DATE, AND DECLARING AN EMERGENCY. WHEREAS, the Boundary Commission established pursuant to Chapter 494 Oregon Laws of 1969 for the Portland Metropolitan Area, by its final order dated Sept. 17. 1975____._ approved the hereinafter described change in the boundaries of the City of Tigard, and a copy of said final order has been filed with the City Recorder, NOW THEREFORE, THE CITY OF TIGARD ORDAINS AS FOLLOWS: Section 1: That the final order of the Boundary Con-,mission adopted on the 17th day of Setp emberi_1975 a copy whereof is hereto attar_hed and by this reference made a part hereof, be, and the same is, hereby ratified, confirmed and adopted by reference to the same legal force and effect as if set forth herein in full. Section 2: That the boundaries of the City of 'Tigard be, and they are hereby, changed to include the lands as described in the within order of the Boundnry Commission, and the corporate limits of the City of Tigard are hereby changed in conformity therewith. Section 3: That the Recorder of the City of Tigard be, and she -- is hereby, directed to forthwith file a copy of this ordinance, including a copy of said Order, in the following offices: (a) Secretary of State (b) Department of Revenue and Taxation, Washington County (c) Department of Records and Elections, Washington County (d) Department of Public Works, Attention: Surveyor, Washington County Section 4: That the City Planning Coranission be, and it is hereby, authorized and directed to conduct such proceedings as may be necessary to conform the authorized zoning and land use of the described premises to the requirements of the City's Zoning Map and Code. Section S: Inasmuch as it is necessary for the peace, health and `— safety of the people of the City of Tigard that the foregoing change in the boundaries of the City become a permanent part of the City's records, an emergency is hereby declared to exist, and this ordinance shall be effective upon its passage by the Council, and approval by the Mayor. Hall Street - Portland, Oregon 97201 - Tel : 229-5307 FINAL ORDER RE: BOUNDARY CHANGE PROPOSAL NO. 846 - Annexation of territory to the City of Tigard Proceedings on Proposal No. 846 commenced upon receipt by the Boundary Commission of a petition from property owners on July 21 , 197S request- ing that certain property be annexed to the City. Upon receipt of the petition the Boudnary Commission published and posted notice of the public hearing in accordance with ORS 199.463 and conducted public hearings on the proposal on August 20 and September 17 , 197S. The Commission also caused a study to be made on this proposal which considered economic, demographic and sociologi- cal trends and projections and physical development of the land. FINDINGS On the basis of the public hearings and the study the Boundary Com- mission found that: 1 . The original territory to be annexed is contiguous to the city, contains 24 acres , 16 single family dwellings , and an estimated population of 3S persons . 2 . The petitioners desire annexation to the City of Tigard in order to secure city services which will facilitate development of the territory. 3 . The entire area is zoned RU-4 (Urban Residential) by the county and is designated for residential use by the Washington County Comprehensive Plan. 4 . The City of Tigard's plan designates the area "Residential-Com- mercial" which includes higher density residential use and commer- cial uses such as office buildings . S . The territory is in the Metzger Water District which has a 12" main designed to serve the proposed use of the land. 6. A sanitary sewer line runs adjacent to the territory and could be extended into the area after annexation. 7 . Fire protection to the area is provided by Tualatin Valley Fire District. Fire protection would continue to be provided by that district after annexation. 8 . Upon annexation, the City of Tigard would supply other services t such as police, planningand zoning, building inspection, street maintenance, street lighting, etc. Page 1 FINAL ORDER 9. A number of property owners and residents objected to being included in the city , citing that the City has no services which they need nor desire. 10. The modified area to be annexed contains approximately 10. 5 acres , six single family dwellings , and an estimated population of 18 persons. On the basis of the findings the Commission determined that: 1. The territory is designated for Residential-Commercial use by the City of Tigard Community Plan. Such use of the territory is dependent upon annexation to the city. 2 . The territory is in the Metzger Water District which has a 12-inch water main passing through the subject territory. This main is designed to serve the type of development proposed by the city plan. 3. Sanitary sewer service could be provided to the area by extending an existing main which is in SW 68th Ave. adjacent to the territory. Such service cannot be provided prior to annexation. 4 . Upon annexation the City of Tigard would supply other services to the area such as police, planning and zoning, building inspec- tion, street maintenance , street lighting, etc. S. The property owners and residents west ,of SW 69th do not desire to be included in the City at this time and inclusion of that area now would seem to be premature and might jeopardize the successful annexation of the remaining area. ORDER On the basis of the findings and reasons listed above the Boundary Commission approved BOUNDARY CHANGE PROPOSAL NO. 846 as modified on Scpteritber 17, 1975.
