Ordinance No. 75-43 CITY OF TIGARD, OREGON ORDINANCE No. 75 - � AN ORDINANCE ADOPTING FINDINGS WITH RESPECT TOA PLANNING R�ING COMMISSION INITIATED CHANGE IN ZONE CLASSIFICATION4, 15, 16, 17 AND 18 OF THE LAKE NAL TO R-7 RESIDENTIAL ON LOTS 1, 2, 3, TERRACE SUBDIVISION, GRANTING ZONING CHANGE AND DECLARING AN EMER- GENCY. THE CITY OF TIGARD ORDAINS AS FOLLOWS: Section 1: The Council finds that the lands hereinafter described have heretofore been and are now classified R-15 (single family residential) pursuant to the zoning ordinances of the City of Tigard. Section 2: The Council further finds that pursuant to prescribed pro- cedures, application for change of zone of said lands from he Planning R-15 to R-7 was the subject of and public u liche C earin onehasld bheretofore filed Commission on August 9, corder, recommending approval of the apph- its report with the City Re cation. Section 3: The Council further finds that after due and legalnotice, before a public hearing was held on September 8, 1975, an impartial Council, and that at said hearing the applicant and all interested parties were afforded an opportunity to be heard and to , present and rebut evidence with respect to said application. Secorl 4: The Council further finds that the granting of said zone - change from R-15 to R-7 will correct an error made by the Planning Commission when, in 1973. they appraved the Lake Terrace Sub- 4. division with the lots 1, 2, 3, 4, 15, 16, 17 and 18 having an area f of 8,000 square feet when the applicable R-15 zoning stipulated a minimum lot size of 15,000 square -feet. and the Section 5: Based on the evidence b record of said hebeforeathe Cityth andcumentaCauncil,, the Council makes- he followingfindings r �,ve plan entitled "Tigard Community (a That r the „ompr ehen. Plan" specifies the subject parcels for single family residential development at densities equivalent to those prescribed by the R-7 (single family residential) zone. The subject change in zone therefore conforms to the Comprehensive Plan for this area. K: (b) The granting of the application is compatible with the surrounding Oevelopment pattern and will not have an undesirable impact upon area of the City zoned ; 3 r r 3.
