AN ORDINANCE AMENDING CHAPTER 18.72 (CONDITIONAL USES) OF THE TIGARD
MUNICIPAL CODE, PROVIDING A NEW SECTION, CLARIFYING TIT: RIGHTS OF
CERTAIN LAND OWNERS WITH REGARD TO PROPERTIES, THE USE OF WHICH HAS r
BECOME CHARACTERIZED AS A CONDITIONAL USE AFTER THE DATE OF THE
COPOENCEMF.NT OF SUCH USE; AND DECLARING AN EFFECTIVE DATE.

THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section 1: '.Pile zoning" oi7d,t.iianccs of the City of Tignr.d creating the
various land-use zones describe uses which are permitted
in each zone, and, in a number of instances, also describe uses which
are to be permitted as "conditional uses" within each zone.
Section 2: The Council finds that the zoning ordinances of the City
of Tigard do not describe, with sufficient clarity, the
rights of the owner of a parcel of land which, at the time of develop-
ment or at the commencement of its use, conforms in that development
or use to the provisions of the applicable zoning classification,
being classified as a "permitted use", which land is thereafter
affected by a change in a zoning ordinance rendering the existing
use permissible within that zone only as a "conditional use."
Section 3: In order to make clear what rights the owner of land
such as that described at rection 2 above shall have, the
following language is hereby added to the City of Tigard zoning
ordinance of 1970, where it shah appear in tale Tigard .Municipal
Code as the Section following 18.72.030, the Codification of Ordinance
72-52, section 5, 1972 and Ordinance 70-32, section 23-3, 1970:

Section 4: This ordinance shall be effective on and after the
31st day of its passage by the Council and approval
by the Mayor. f`
