Ordinance No. 75-40 Q 1' CITY OF TIGARD, OREGON ORDINANCE No. 75-40 AN ORDINANCE AMENDING THE TIGARD MUNICIPAL CODE, CHAPTER 18.12, GENERAL PROVISIONS, WITH RESPECT TO VISION CLEARANCE STANDARDS AT INTERSECTING STREETS AND CENTERLINE SETBACKS FOR DESIGNATED ARTERIAL AND COLLECTOR STREETS; PRESCRIBING AN EFFECTIVE DATE AND DECLARING AN EMERGENCY. THE CITY OF TIGARD ORDAINS AS FOLLOWS: Section 1; The City Council finds that pursuant to Chapter 197 ORS and Ordinance No. 70-32 - "City of Tigard Zoning Ordinance of 1970" - the hereinafter stated amendments to said zoning ordinance, after due and legal notice, were submitted to public hearing by L;« , pinnnine Commission on April 1, 1975, and to .. the Council thereafter recommended that said zoning ordinance be amended as hereinafter set forth. Section 2: The Council further finds that after due and legal notice a public hearing was held by the City Council on August 11, 1975, whereat all interested persons were afforded an op,ortunity to be heard with respect thereto, and conditions precedent fulfilled with respect to the following amendments to the City's zoning ordinance. Section 3: The Council further finds that the purpose for these amendments is to protect the public health, safety and general welfare, especially as relates to traffic hazards, and congestion; and furthermore, said amendments serve to implement the City's objectives and policies concerning traffic circulation as stated in the Tigard Community Plan, Neighborhood Plan Number One and Neighborhood Plan Number Two. Section 4: That Chapter 18.12, General Provisions, be amended to read as follows: 18.12.100 Yard Requirement Exceptions (b) Vision clearance areas. In all zones, vision clearance areas shall be maintained at all intersections of public streets. The vision clearance area shall be not less than twenty feet on a side as defined in section .08.560 of this title. On all designated arterial streets (in subsection "d" of this section) the vision clearance area shall be not less than thirty-five feet on a side. Except for occasional tree trunks and poles, these areas shall be maintained without sight obstruction of any kind for a vertical distance of between three and eight feet above ground. 18.12.100 (d) Additional Setbacks (d) To permit or afford better light, air and vision on more heavily traveled streets and on streets of substandard width; to protect arterial streets; and to have the location of structures compatible with the need for the eventual widening of streets, a setback shall be provided abutting streets and portions of streets hereinafter named which shall be greater than the required yard dimension specified in the zone by the number of feet set forth below in the right hand column, measured at right angles to the centerline of the street and, unless otherwise described, measured from the centerline of the street as constructed and improved with a ORDINANCE No. 75-40 t t3 i r s hard surface pavement, or where not paved, from the centerline or general extension thereof of the street right-of-way: Additional Center Line DESIGNATED ARTERIAL STREETS Setback Required All of SW Durham Road within the City 40 All of SW Greenburg Rd.
