Ordinance No. 75-28 13 CITY OF TIGARD, OREGON ORDINANCE NO. 75 - -?Y AN ORDINANCE AMENDING ORDINANCE NO. 70-32 ENTITLED "CITY OF TIGARD ZONING ORDINANCE OE' 1970", AS AMENDED, AND AS CODIFIED IN TITLE 18 OF THE TIGARD MUNICIPAL CODE, BY ADDING A NEW CODIFIED CHAPTER DESIGNATED CHAPTER 18.30, ESTABLISHING A MAIN STREET COMMERCIAL ZONE, DESIGNATING THE BOUNDARIES THEREOF BY ATTAf_WF.n ZONING MAP; PRESCRIBING A14 EFFECTIVE DATE A.hi!',) i I:X AN EFFECTIVE DATE. THE CITY OF TIGARD ORDAINS AS FOLLOWS: Section 1: The City Council finds that pursuant to Chapter 227 ORS and "City of Tigard Zoning Ordinance of 1970" No. 70-32, the amendments to said zoning ordinance hereinafter appearing, after due and legal notice, were submitted to public hearing by the City Planning Commission on May 20, 1975, and to the Council there- after recommended t',at said zoning ordinance be amended as herein- after set forth. Section 2: The Council further finds that after due and legal notice a public hearing was held by the City Council on June 9, 1975, whereat all interested persons were afforded an opportunity to be heard with respect thereto, and conditions pre- cedent fulfilled with respect to the following amendments to the City's zoning ordinance. Section 3: The Council further finds that the purpose for these amendments is to protect the public health, safety and general welfare and furthermore, said amendments serve to implement the City's objectives and policies concerning commercial develop- ment as stated in Neighborhood Plan Number One. The Main Street commercial district o�differs significantly in development pattern from commercial properties abutting S. W. Pacific Highway within the City and vehicular traffic problems and congestion are less severe on S. 11. Main Street in providing direct access therefrom to commercial properties. Section 4: The'City of Tigard Zoning Ordinance of 1970" No. 70-32, as heretofore amended and as codified in Title 18 of the Tigard Municipal Code, be and the same is hereby amended to add a new codified chapter numbered 18.30, reading as follows: Chapter 18.30 MAIN STREET COMMERCIAL ZONE (C-3M) Sections: 18.30.010 Permitted uses. 18.30.020 Conditional uses. 18.30.030 Lot requirements. 18.30.040 Setback requirements. 18.30.050 Building height. 18.30.060 Additional requirements. 18.30.010 Permitted uses. (Ord. 74-49 §1, 1974; Ord. 72-70 §2, 1972; Ord. 70-32 9140-2, 1970) . 18.30.030 Lot requirements. In the C-3M zone the lot requirements sna e as mallows: (1) The minimum lot area shall be six thousand square feet; (2) The minimum lot width shall be sixty feet; (3) No maximum lot coverage shall be required. (Ord. 70-32 §140-3, 1970) . 18.30.040 Setback requirements. Except as may other- wise be provided in SectioFi 18.1 .100, the setbacks for non- residential uses in the C-3M zone shall be as follows: (1) The minimum front yard shall be ten feet, land- scaped and maintained; (2) No side yard setback shall be required, except when abuttinq a residential zone, a side yard of five feet shall be required; (3) No rear yard setback shall be required, except when abutting a residential zone, a rear yard setback or tw-nty- five feet shall be required. Except as otherwise pro- vided in Section 18.1 .i10, no building in the C-3M zone shall exceed a height of three stories or thirty-five feet which- ever is less. (Ord. 70-32 §140-5, 1970) . 18.30.060 Additional requirements. Additional require- ments app zca e to t.e C-3M zone include but are not limited to the following: (1) Off-street parking and loading, see Chapter 18.60; (2) Access and egress, see Chapter 18.64; (3) Enclosure and screening required, see Section 18.12.080; (4) Signs, advertising signs and sign structures shall be subject to the conditions, limitations, prohibitions and requirements of Title 16, to which particular reference is made; (5) Nuisances prohibited, see Section 18.12.070. Section 5: Each lot, tract, parcel of land, or portion thereof, within the boundaries of the Main Street commercial zone, as designated, depicted and marked on the attached map, designated Exhibit "A", and by this reference, made a part hereof, ! is hereby classified for use and limited to the uses hereinabove set forth with respect to said zone, subject to the requirements of this ordinance and the applicable provisions and procedures of the "City of Tigard Zoning Ordinance of 1970", as amended and as hereby further amended, as codified. in Title 18 of the Tigard Municipal Code, as heretofore or hereafter amended and supple- mented, and said official map shall be and remain on file as a part of this ordinance at all tines in the office of the City Recorder. -3- ORDINANCE NO. 75 - $F ai�amixs�c � SECTION 6: This Ordinance shall be effective on the 31st day after its passage by the Council and signature of the Mayor.
