Ordinance No. 75-27 i CITY OF TIGARD, OREGON ORDINANCE No. 75 - .Zl t AN ORDINANCE ADOPTING FINDINGS WITH RESPECT TO ZONE CHANGE APPLI- CATION OF RANDY AND KAREN SCHULTZ FROM WASHINGTON COIjNTY ZONING DESIGNATION RU-4, URBAN RESIDENTIAL DISTRICT-HIGH, LOW DENSITY TO C-P, COMMERCIAL-PROFESSIONAL, WITH RESPECT TO TAX LOTS 1:00 AND 1200, TAX MAP 1S1-1AD; GRANTING APPLICATION AND FIXING Aif EFFECTIVE DATE. THE CITY OF TIGARD ORDAINS AS FOLLOWS: Section 1: The Council finds that the lands hereinafter described have been heretofore and are now classified as RU-4 Urban Residential District - High, Low Density, pursuant to the provisions of the Washington County zoning ordinance, and that said lands have not been rezoned by the City subsequent to the annexation thereof to the City. Section 2: The Council further finds that pursuant to prescribed procedures, application :for a change of zone of the entirety of said lands from the present classifications as herein stated to C-P, Commercial-Professional, was the subject of a public hearing held by the Planning Commission on April 159 1975, and all interested persons were then and there afforded an opportunity to be heard, and thereafter the Planning Commission filed its report and recommendations with the City Recorder, copy whereof is hereto attached and by reference made a part hereof, recommending approval of said application and change of zone. Section 3: The Council further finds that after due and legal notice a public hearing was held on June 9, 1975, be- fore the City Council and that at said hearing the applicant and all other parties desiring to be heard were afforded an opportunity to be heard and present and rebut evidence with respect to said appli- cation. Section 4: Based on the evidence, both oral and documentary, and the record of said hearing before the City Council, the Council makes the following findings: 1. This site has recently been approved for annexation to Tigard by the Metropolitan Boundary Review Com- mission. 2, The Tigard Community Plan identifies this area as °commercial-residential" and the Tigard Triangle Plan more specifically recommends office park de- velopment. 3. Sewer is available approximately 100' from the SW corner of the site. 4. Public water mains are to be bid soon for 67th. z 5. Surrounding present land use is predominantly resi- dential to the north east and west of the site, but is apparently being held speculatively in antici- pation of commercial development. Land use to the south of the site is recent commercial office de- velopment. ORDINANCE No. �r _ f Section 5: That the use classification of applicant's lands as described on the attached Exhibit "A" by reference made a part hereof, being Tax Lots 1100 and 1200, Tax Map 1S1 1AD, be, and the same is hereby changed in the respective parts thereof from RU-4 Residential District - high, Low Density, Washington County classification, to C-P Commercial-Professional, as set forth in Title 18 of the Tigard Municipal Code, and the use there- of shall be subject to the requirements of such zoning classification and further, subject to the conditions hereinbelow listed: 1t applicant provide curbs and sidewalks on his frontage on Hampton Street and on 67th to the north side of his must northerly parking lot entrance. 2_ Street surface to match existing be provided up to new curb line (based on 54' street wiaLn). 3. Applicant has agreed that a non-remonstrance agreement be executed allowing the value of street improvements be deducted from future L. I. ll. 's. 4. That proposed building site and parking configuration be arranged as to accomodate future street alignments and vacations. Section 6: This ordinance shall be effective on and after the 31st day after its passage by the Council and approval by the Mayor.
