ORDINANCE NO. 75 -
AN ORDINANCE CALLING A SPECIAL ELECTION TO BE HELD ON THE
DAY OF MAY, 1975, FOR THE PURPOSE OF SUBMITTING TO THE VOTEtS
AN AMEFDMENT TO THE CITY CHARTER BY ADDIRG THERETO CHAPTER 10,
SECTION 45, ENTITLED "ZONING AND LAND PLANNING" PROPOSED BY
INITIATIVE PETITION; FIXING AN EFFECTIVE DATE AND DECLARING
AN EMERGENCY.
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section 1: That pursuant to the initiative prov_ 3ions of
Chapter 1.12 of the Tigard Municipal Code, a
special election is hereby called to be held in the City of
Tigard on the 27th day of May, 1975, between the hours of
8:00 o'clock A. M. and 8:00 o'clock P. M., at the polling places
hereinafter designated, for the purpose of submitting to the
legal voters of the City an amendment to the City Charter pro-
posed by initiative petition as hereinafter set forth.
Section 2: That the following form of ballot, ballot title, and
statement of chief purpose of proposal are hereby
approved for submission to the voters at said election:

Charter Amendment Proposed by Initiative Petition:
SCHOOL PROXIMITY VEHICULAR TRAFFIC-LIMITATION MEASURE
Purpose: within 750 feet of schools, for certain

51. constructing and operating new facilities, remodel-
ing, or operational changes in pre-existing businesses.

"SCHOOL CHILDREN PROTECTION AMENDMENT"
Initiative petition amending City Charter, Chapter
10, Section 45; Zoning and Land Planning. Regardless
of.zoning there shall not be a restaurant, fast food
service, drive-in, or other such high volume traffic
business, constructed or operated within 750 feet of
the nearest perimeter of any public or parochial school
ground, except those currently in operation and are
within these areas. None of the currently operating
restaurants within these areas shall remodel or change
their operation in such a manner as to conflict with
the intent of this amendment.

Section 3: That the polling places in the precincts, designated
ilk on the attached Schedule "A", are hereby approved and
it
adopted, and the persons named on the attached Schedule "B", by
this reference made a part hereof, with respect to each precinct
and polling place shown thereon, are designated to serve as members
of each Board of Election, who shall take the oath prescribed by
law to faithfully perform the duties of said offices.
Section 4: In all respects the conduct of said election shall
conform to the procedures established by law, except
as herein modified, and the City Recorder be, and she is hereby,
authorized and directed to notify the designees of their appoint-
ment to serve as election board members. The City Recorder be,
and she is hereby, further authorized and directed to take such
further action required to obtain poll books, and prepare or cause
;r. to have prepared ballots and other election materials as necessary
to the proper conduct of said election, and to incur all needful
and necessary expenses incident thereto.
Section 5: That the City Recorder be, and she is hereby, directed
to give notice of the said election and the initiative
proposal in the manner following:
`.; (a) By publishing a copy of this ordinance in full in
one (1) issue of the Tigard Times within twenty (20) days immedi-
ately prior to the election.

�Y' (b) By posting notices of said special election, one at each
of the designated polling places in each of the precincts in the
City not less than ten (10) days prior to the date of the election
and also by publishing notice in the Tigard Times, once each week
for two consecutive weeks, the first of such publishings to be x
e0- not less than ten (10) days prior to the date of election.
Section 6: That inasmuch as it isnecessarythat the initiative

proposal, as hereinabove set forth, be submitted to
" the legal voters of the City with the least possible delay, and
" it is necessary for the peace, health and safety of the people of
re the City of Tigard that the election be at the earliest
` possible date, an emergency is hereby declared to exist, and
this ordinance shall take effect upon its passage by the Council
