ORDINANCE NO. 75-9
AN ORDINANCE AUTHORIZING THE ISSUANCE OF GENERAL OBLIGATION BONDS OF
THE CITY TO OBTAIN FUNDS WHEREWITH TO ACQUIRE FROM SCHOOL DISTRICT N0.
23-J (TIGARD), WASHINGTON COUNTY, OREGON, THE REAL PROPERTY AND STRUC-
TURFS CONSTIT-UTI14G THE FORMER FOWLER JR. HIGH SCHOOL SITE ON MAIN STREET
IN TIGARD, OREGON, FOR USE FOR LIBRARY, CITY HALL, AND CIVIC CENTER
PURPOSES AND TO FINANCE STUDIES NECESSARY TO MAPF: A DETERMINATION WHET,, R
TO WE, REMOVE OR PRESERVE, IN WHOLE OR IN PART, EXISTING STRUCTURES,
CALLING A SPECIAL ELECTION FOR THE PURPOSES OF SUBMITTING TO THE LEGAL
VOTERS THE CUESTION OF INCURRING A BONDED INDEBTEDNESS OF NOT TO EXCEED
b500,000.00 FOR SAID PURPOSES: FIXING AN EFFECTIVE DATE AND DECLARING
AN EMERGENCY.
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section 1: The City Council finds that the presently available City Hall
facilities are inadequate to serve the present and future
needs of the City, and that it is in the public interest that immediate
actiur, be taken to provide a Library, City Hall and Civic Center
facilities.
Section 2: That the City Council finds, after a representative canvass
of the people of the City, that a large segment of the
population favor the acquisition of the former Fowler Jr. High School
site on Main Street in the City of Tigard, heretofore declared surplus
to the needs of School District No. 23-J, I%'ashington County, Oregon,
said premises being described as follows:
That portion of land in Township 2 South, Range 1 West,
Willamette Meridian, Washington County, Oregon, being
more particularly described as follows:
All of Lots 5, 6, 7, 8, 14 and 15 of Tigard. Highway Tracts,
a subdivision of record in said County. EXCEPTING
THEREFROM, those portions thereof which lie within dedicated
public right-cf-way.
Containing 6.80 acres.
Section 3: That the City Council finds that pursuant to ORS 287.004,
the City Charter does not expressly provide to the contrary
and therefore the Council, as the governing body of the City may,
without Charter amendment, issue bonds upon approval by the voters of
the City by a ma4ority of those voting upon the question of issuance of
bonds.
Section 4: That the City Council further finds that the former Fowler
Jr. High School site is to be sold through competitive bid
procedures by School District 23-J (Tigard) and that if the City is the
successful bidder the estimated initial requirements for the acquisition
from School District No. 23-4 (Tigard), Washington County, Oregon, of
the real property and structures constituting the former Fowler Jr. High
School site on Main Street, in Tigard, Orcgon, for use as .Library, City
Hall and Civic Center purposes, and to finance studies necessary to make
a determination whether to raze, remove or preserve, in whole or in part,
existing structures, and to provide funds to construct, raze, remove or
preserve in whole or in part, existing or new structures on -this site
approximates the sum of $500,000.00, and that the said funds are not
available except through the issuance of general obligation bonds of
the City, and, accordingly, a special election is hereby called, to be
held on the 13th day of March, 1975, between the hours of 8:00 o'clock
A. I. and 8:00 o'clock P.M., Pacific Daylight Time, at the polling places
in the precincts designated on attached Schedule "A", by this reference
made a part hereof, for the purpose of submitting to the legal voters

of the City for approval or rejection th6 hereinafter stated measure.
The election on said question shall be held in accordance with the pro-
visions of the Charter of the City of Tigard anal the applicable election
laws of the State of Oregon.
Section 5: The City Recorder be and she is hereby authorized and directed
to cause to have this ordinance published in full in the
Tigard Times, a newspaper published and of general circulation in the
City of Tigard, Oregon, in the issue of - March 2, 1975, and to further
give notice of said special election by posting notices thereof, one in
each of the precincts of the City and in each polling place, not later
than -- March, 2, 1975, and further by publishing notice of said election
once each week for two consecutive weeks, the first publication of
election notice to be on - March, 2, 1975, and the second on March 9,
1975• The City Recorder is further directed to file herein an Affidavit
of Poctir.g i; conformity herewith and the City Recorder is hereby
wi+hnrized and directed to incur such expenses necessary in procurring
from the Elections Officer of Washington County, Oregon, poll books of
elegible voters and to prepare or cause to have prepared such ballots
and other election materials as necessary to the proper conduct of said
election.
Section 5: That the persons named on the attached Schedule "B", by this
reference made a part hereof, with respect to each precinct
and polling place shown thereon are designated to serve as members of
Boards of Election and Phall take the oath prescribed by law to faith- p
fully perform the duties of said offices.
Section 7: The official ballot title for the proposed measure and
caption: thereof which shall appear on the official ballot
to be submitted to the legal voters at the special election to be held
on March 13, 1975, is hereby authorized and approved as follows:

Shall the City of Tigard issue general obligation bonds
in principal sum not to exceed $500,000.00, payable
during a term not exceeding twenty-five (25) years
wherewith to (1) acquire from School District No. 23-J ry
(Tigard), Washington County, Oregon, the real property
and structures constituting the former Fowler Jr. High
School site on Main Street in Tigard, Oregon, for use 4.
51. for Library, City Hall, and Civic Center purposes and
(2) to finance studies necessary to make a determination
whether to raze, remove or preserve, in whole or in part,
existing structures and (3) to provide funds to construct,
raze, remove or preserve in whole or in part, existing or new
structures on this site, pledging the City's general credit
' and taxing power for the payment of said bonds, includingAl
principal and interest subject to outstanding bonds for
which previous pledges exist.

I vote against -the proposal.

Section 8: Inasmuch as the sale date projected by School District '
No. 23-J (Tigard). Washington County, Oregon, with respect
- to the disposal of the Main Street Fowler Jr. High School site is shortly
forthcoming, it is necessary for the peace, health and safety of the
people of the City of Tigard that the foregoing measure be submitted
with the least possible delay, an emergency is hereby declared to exist, '
r : and this ordinance shall become effective upon its passage by the
Council and approval by the Mayor.
