ORDINANCE NO. 75 -
AN ORDINANCE AMENDING CHAPTER 14,06 OF THE TIGARD MUNICIPAL CODE
AS AMENDED BY SECTION 2(c) OF ORDINANCE NO. 74-33; AMENDING SECTION
14.04.050 OF THE TIGARD MUNICIPAL CODE WITH RESPECT TO BUILDING
PER14IT FEES; AMENDING AND SUPPLEMENTING SECTION 14,04,063 WITH
RESPECT TO USE AND OCCUPANCY OF RESIDENTIAL STRUCTURES AND ISSUANCE
OF CERTIFICATES OF OCCUPANCY; REPEALING SUB-SECTION 306(f) (3) OF
SECTION 14.04.064 OF THE TIGARD MUNICIPAL CODE; REPEALING SECTIONS
14,04.060 AND 14.04.080 OF THE TIGARD MUNICIPAL CODE; FIXING AN
RFPRCTIVE DATE AND DECLARING AN EMERGENCY.
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section 1: That Section 2(c) of Ordinance No. 74-33 with respect
to Chapter 14.06 of the Tigard Municipal Code be and
the same is hereby amended to read as follows:
"Section 2: (c) That not less than three (3) copies
of the 1973 Edition of the Uniform
Building Code for the Abatement of Dangerous Buildings
as published by the International Conference of Build-
ing Officials shall be kep+- and maintained on file in
the Office of the City Recorder for use and examination
by the public pursuant to ORS 221.330."
Section 2: That Section 14.04.050 of the Tigard Municipal Code
be and the same is hereby amended to read as follows:
"Section 14.04.050. Building Permit Fees. Section
303(a.) o the-M-3 Edition o t e Uni orm Building
Code as adopted by Section 14.04.020 of the Tigard
Municipal Code be and the same is hereby amended to
read as follows:
(a) No fees shall be exacted for work under-
taken by the City of Tigard; by the State
of Oregon, its subdivisions or agencies;
by the Federal Government, its subdivisions
or agencies; by Washington County, or by
any school district, if the work be done
by such governmental units' own employees.
(b) No permit will be required for work involv-
ing less than $100.00 valuation where no
structural changes are made.
(c) Fees for the issuance of permits for circuses,
animal shows, wild west shows or similar exhibi-
tions held in tents shall be $100.00.
(d) All fees for other activities conducted with-
in the purview of Title 14 of the Tigard
Municipal Code shall conform to Section
303(a) and 303(b) of the 1973 Edition of the
Uniform Building Code adopted by Section
14.04.020 of the Tigard Municipal Code,
except with respect to
Plan-checking Fees. Gronp I and J occupancies
involving repeated use of the same,or similar

building plans covering residential units as
part of one development, the fee for plan- ,
checking services with respect to the second
and successive permits shall be computed at
f the rate of $10.00 per permit."
Section 3: That Section 14.04.063 of the Tigard Municipal Code
be and the same is hereby amended to read as fol-
lows:
"Section 14.04.063. Use or Occupancy--Maintenance of
Nan-Occupancy_ igns. That Section 30 o the Uniform t
Bluing Code, 1973 Edition, is hereby amended to read as
follows: j
"Section 306(a), Use or occupancy: No building
or structure in Groups A to H and no single or
multiple family residential structure shall be 1
used or occupied, and no change in the existing s
occupancy classification of a building or struc-
ture or portion thereof, including said residential
structure, shall be made until the Building Official
has issued a certificate of occupancy thereof as

provided herein.
"Section 306(a-1) . The builder of each occupancy k
unit shall keep and maintain, in a conspicuous 5
place at the front main entrance to each occupancy
unit at all times after the permanent entrance
doors thereof are installed until a unit occupancy j
permit has been issued by the City Building Official,
a sign in form prescribed by the Building Official,
notifying interested persons that such unit may
not be occupied until an occupancy permit has f
been issued by the Building Official. r
"Section 306(b) Change in Use. Changes in the char-
acter or use of a building shall not be made except
as specified in Section 502 of this Code.
"Section 306(c) Certificate Issued. After final
inspection when it is found that the building or
structure complies with the provisions of this Code, ,
the Building Official shall issue a Certificate of
Occupancy which shall contain the following: 7
1. The building permit number.
2. The address of the building. it
3. The name and address bf the owner.
4. A description of that portion of the building
for which the certificate is issued. ,
5. A statement that the described portion of the
x building complies with the requirements of this
Code for group and division of occupancy and
the use for which the proposed occupancy is
classified.

"Section 306(d) Temporary Certificate. A temporary
i
Certificate of Occupancy may be issued by the
Building Official for the use of a portion or por-
tions of a building or structure prior to the com-
pletion of the entire building or structure.
"Section 306(e) Posting. The Certificate of Occu-
pancy shall be posted in a conspicuous place on the
premises and shall not be removed except by the
Building Official."
Section 4: That sub-section designated 306(f) (3) of Section
14.04.064 of the Tigard Municipal Code, as re-
enacted by Section 5 of Ordinance No. 74-34 passed by the City
Council on the 24th day of June, 1974, with respect to non-
occupancy notices and signs be and the same is hereby repealed.
Section 5: That Sections 14.04.060 and 14.04.080 of the Tigard
Municipal Code be and the same are hereby repealed.
Section 6: Inasmuch as it is necessary that the Building Code of
the City of Tigard currently reflect the provisions
of the Uniform Building Code as adopted by the State of Oregon,
it is hereby declared to be necessary for the peace, health and
sf safety of the people of the City of Tigard that this Ordinance
become effective with the least possible delay, and an emergency
is therefore hereby declared to exist and this Ordinance shall
become effective upon its passage by the Council and approval by
the Mayor.
PASSED: By the Council, by vote of all Council
members present, after�eing read three times by
