ORDINANCE NO. 74 -
AN ORDINANCE REPEALING SUB-SECTIONS 306 (f) (1) AND 306 (f) (2)
OF SEC. 14.04.064 OF THE TIGARD MUNICIPAL CODE, AS RE-ENACTED
BY SECTION 5 OF ORDINANCE NO. 74-34 WITH RESPECT TO EXECUTION
AND RECORDING OF OCCUPANCY RESTRICTIONS OF NEWLY CONSTRUCTED
k(ESIDENTIAL UNITS, F_TXING AN EFFECTIVE DATE AND DECLARING
AN EMERGENCY.
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section 1: That Sub-sections designated 306 (f) (1) and 306 (f) (2)
of Sec. 14.04.064 of the Tigard Municipal Code, as
re-enacted by Section 5 of Ordinance No. 74-34 passed by the City
Council on the 24th day of June, 1974, requiring the execution
and recording of occupancy restrictions with respect to newly con-
structed residential structures be and the same are hereby re-
pealed.
Section 2: That inasmuch as the said occupancy restrictions are
no longer required and the immediate repeal thereof
is necessary to avoid undue hardship, confusion and misunderstand-
ing, it is necessary, for the peace, health and safety of the
people of the City of Tigard, that this ordinance become effective
with the least possible delay, and an emergency is hereby declared
to exist, and this ordinance shall be effective upon its passage
by the Council and approval by the Mayor.
