Ordinance No. 74-41 CITY OF TIGARD, OREGON ORDINANCE NO. 74—�_ AN ORDINANCE AML ORDINANCE N0, bb-i AS AMENDED BY ORDINANCt NO. 71-21 (GARBAGE FRANCHISE GRANTED TO Frank's Disposal Service, Inc. ) DEFINING AND EXCLUDING SALVAGEABLE HATERIAL FROM THE PURVIEW THEREOF, PRESCRIBING RE- VISED RATES FOR COLLECTION AND DISPOSABLE SERVICES THEREUNDER AND FIXIOG AN EFFECTIVE PATE. THE CITY OF TIGARlll ORDAINS AS rOLLOI'dS: Section 1: That Section 2 of Ordinance No. 71-21 _ adopted by the City Council on May 11 1971 as amended by Ordinance No. 73_26 be and the same is hereby amended to read as follows: "Section 2: Definitions. For the purpose of this Ordinance, unless the context other- wise clearly requires, the following definitions are hereby prescribed and made applicable: " (a) "Salvageable material" means cardboard, paper boxes, packing materials, plywood, crating lumber or other salvageable mater- . - ials which have economic value for re-use and disposition through resale to salvage operators or others or disposition through donation to civic or non-profit groups; provided that the seller or contributor from whose business store, shop, warehouse: or other operation the salvageable material results separates such salvageable material from garbage and other waste material and prepares such materials in bales, boxes, bundles, cartons or containers other than garbage containers; and further provided, that such salva--eable materials are retained by the seller or contributor within the con- fines of the store building, industrial yard,,(4zypated, or manufacturing plant wherefrom salvaged and are delivered to the collector or recipi- ent in such bale, box, bundle or container. Commingling of reusable salvageable material with garbageguseless matter and other waste material shall be considered as waste in its entirety and the storage, collection and disposal of such waste material is subject to the requirements of this ordinance relating to waste. " (b) "Boxed refuse" means refuse contained in a box not exceeding the volume of a can nor the weight of 40 pounds loaded, and of sufficient strength and rigidity to safely contain the refuse and permit safe collection. Page 1 - ORDINANCE NO. 74 �� " (c) "Bundld' means non-putrescible solid wastes securely tied in bundles including, but not limited to, twigs, shrubbery trinunings or tree limbs, with a limit of four (4) feet in length and 60 pounds in weight. " (d) "Can" means a metal storage container for solid waste with bails (handles) and a tight fitting lid or cover and not exceeding a capacity of 32 gallons nor a loaded gross weight of 60 - pounds. It- is recommended that such a can shall not be sunk into a receptacle in the ground. " (e) "Collector" means the person, firm or business association to whom the City Council has !!!• granted a franchise under the terms and pro- visions herein contained. (f) "Disposal site" means any land used for the disposal of solid wastes including, but not limited to, dumps, sanitary land fills and composting plants maintained or approved by public authority, but does not include a land fill site which is not used by the public either directly or through a service and which f is used by the owner or tenant thereof to dis- pose of aawdust, bark, soil, rock, building demolition material or non-putrescible indus- trial waste products resulting from the process of manufacturing. (g) "Extra" means non-putrescible solid waste, in the form of bundles, boxed or loose refuse, ? collected during a stop in addition to regular service for metal cans or containers provided to the same customer. (h) "Loose rsfuse" means unconfined non-putrescible solid wastes outside of any container, can or box, including, but not limited to, leaves, grass trimmings, shrubbery trimmings or the like. (i) "Person" means any individual, public or pri- vate corporation, industry, co-partnership, association, firm, trust, estate or any other ; legal entity whatsoever. (i) "Putrescible material" is organic material that can decompose, and may give rise to foul smell- ing, offensive products. " (k) "Service" means the collection, storage, trans- portation and disposal of waste and solid waste. Page 2- ORDINO CE NO. 74 - " (1) "Stop" means a single pickup of solid waste at an accessible storage point provided by a customer. In the case of residential ser- vice, a "stop" shall include picking up a can or cans at one storage point and any extras. In the event of multiple dwellings on the same premises, each dwelling unit shall be considered a "stop" with residential service unless five or more units are served by cans or container^ at a single accessible or storage point. In the latter case,__service shall be considered as commercial service. (m) ''Svliu -.astc" means all nntrescible and non- putrescible wastes, whether in solid or liquid form, except liquid-carried industrial wastes or sewage or sewage hauled as an incidental part of a septic tank or cesspool cleaning ser- vice, but including garbage, rubbish, ashes, paper wastes, street refuse, industrial waste, swill, demolition and construction waste, aban- doned vehicles or parts thereof, discarded home and industrial appliances, manure, vegetable or animal solid and semi-solid waste, dead animals (exclusive of horses, cattle, sheep, hogs, goats, and the like), and other discarded materials. (n) "Waste" means useless, unwanted or discarded materials. " (o) "Waste materials" or "refuse" means solid waste and waste as herein defined." Section 2: That Section 3 of Ordinance No. 71-21 be and the sa.-e is hereby amended to read as follows: "Section 3: There is hereby granted to Frank's Disposal Services Inc._ _ the exclusive privilege and franchise of.collecting waste materials and refuse as in this ordinance defined, ordinaril and customarily discarded from residences, and commercial and industrial establishments, excepting salvageable materialz as herein defined, within that area of the City of Tigard as described on the attached map, Exhibit "A" by this refer- ence made a part hereof, and the right. to haul the same over the City streets for the purpose of disposal, as in this ordinance more particularly described. The rights and privileges hereby granted shall be effective with the effective date of this ordinance and shall remain in effect, subject to the terms and conditions hereof, until Decembe., 31 1975 , unless sooner tern- inated in accordance with the terms hereof. The City shall one year prior to termination of this franchise ordinance commence negotiations with the collector for a new franchise. In the event the City and the collector are unable to reach an agreement on such a new franchise after a period of 6 months, the City may negotiate with any qualified persons." Section 3: That Section 20 of Ordinance 2Jo. 71_21 be and tl-e same is hereby amended to read as follows: "Section 20: The rate to be charged to all persons, firms and corporations by the collector shall be reasonable and uniform taking into consideration the ser- vices rendered by the collector and the rates authorized and charged for similar and equal services rendered in f unincorporated areas and other municipalities within Washington, plultnomah and Clackamas Counties, and shall not exceed those authorized in the attached Schedule "B", _ and by this reference rade a part hereof; and further pro- vided that the collector shall grant no preference in rates to any person, organization or owner foa' any reaoon, but � all charges shall be uniform for the same or similar ser- vices.
